Questions about I 864. Any help would be appreciated!

Hi,

I'm married to a U.S. citizen and we are applying for green card this January. But there are a few questions I have towards Form I 864 Part 6.

1. In Part 6 Sponsor's Employment and Income--question 2 "My Current individual annual income", he moved to my city and didn't start his current job until the end of April. Should he put his year to date salary (April to December) there or just do an estimate and put all 2016 estimated annual salary?

2. If his annual salary is not over 125% poverty line, as long as we have 3 times difference cash assets in his savings and checking account we will be fine correct?

are you adjusting status in the US?

 

anyway, the current individual income is for 2017, it will be a estimated of what he thinks he will make during the whole year up to Dec 31st 2017

 

you would have had to file this year for 2016 to be current income, remember that you will be filing in January 2017, so current income for 2017 is only an estimated guess of what he will be making.

Thank you very much for replying to my post. And yes, I'm adjusting status in US. I was just wondering if you happen to know what would happen if my green card is approved later in 2017 but my husbands total income at the end of 2017 is not as much as we estimated on I 864.  My husband and I are actually thinking about quitting our current jobs and moving to other places in the States after my green card is approved.

He's been work at his current job since April but he doesn't like it and wanting to switch to other jobs. But I told him to wait until my green card is approved.
