i-601 waiver and or i-212

the lawyer said to file the waiver now so i have it at the interview 

there are 2 kinds of 601 

one is outside USA i-601 the other is inside USA i-601A 

wont they just deny my visa if i have the bar so what would be the point? dont i have to lift the bar first?

As I said, I hired lawyers but unlike your story I am pleased with mine. I have gotten nothing but good advice and been successful (knock on wood). It is just the process this all must take, you cannot get a waiver without an approved application.

There are two kinds of waivers, yes, but the I-212 is for people who were in deportation proceedings. Unless you were about to be deported? By the sounds of your story, you left one day to return home to take care of family.

your lucky with your lawyers others not so

i left the US on my own but i think because i tried to return and they stopped me at the us border 

verbally they said asked me if i would voluntarily leave but the paper i have states I have been.....ordered moved from the US under expedited proceedings and barred from reentry for a period of 5 years.

The USCIS officer at the Windsor Detroit port of entry that did my interview at the border was very informative - because I had just up and left one day and did not file for adjustment within the US nor was in proceedings to be deported (exit interview)  I had to go through an interview with him then and there. I took it as border patrol speak to mean basically since I had not talked to anyone before them on that day - they needed my story on file.

i had a 6 hour INTERROGATION not an interview like  a criminal at the seattle border. your lucky east coast is a lot cooler. west coast has ....*#! made me feel like for leaving my dad behind to go to the states, horrible daughter. Months later my dad passed away. So it haunts me. 

I will definitely not go through there again. Plane or east coast border for sure. Maybe Detroit will be better haaa

I am so sorry to hear that. I completely understand what you mean. I have been back in Canada two years now.

My math was off and once I was down the rabbit hole ... no excuses but it does happen and we arent the only ones. What is important now is we help you and your husband get home!

I left and tried to go home to see my father in law before he passed - that was when they interviewed me and gave me the ten year bar. There is good news though - you did not take part in something far worse and it sounds like you might qualify for the waiver.

The important thing now is, stay positive, dont make things worse and look into meditation ... some form of soothing because patience is important (I lack patience).  So ... maybe phase one is to open up your I130 application? See if you need to update any of that ....

Thats so sad. I lived over in Kamloops BC before so I know what you mean by the west coast border patrol. And yes, it was an interrogation, perhaps I was being too Canadian about it when I said interview but I did break the law and I had to accept a bit of the responsibility.

That would haunt me too - you're not a horrible daughter, I think our parents want us to be happy and sometimes that takes us far from home. It is why I opened up with the idea we have to forgive ourselves a bit, to get you both home safe and sound, we have to get to a point where we let ourselves off the hook some. This is a stressful thing you are about to embark upon - focus ... you can do this!!!

Some of the people here seem to have a lot of experience with the I130 ... while that is going on read up on waivers .... and before you know it you will both be home!

You cant do anything until you file your CR1 - which takes a year!

there is nothing around that! it is a normal part of the visa applicaiton! so the sooner you do that, the better! 

then when you go to the montreal interview they will let you file the 601 waiver - you dont even need to worry about the waiver for a year! lots of time to figure it out! but like they said, that will be a huge headache and another 1 year wait!!!

you are looking at 2 years with a waiver, and i guess 3 years with no waiver!  you can apply for the CR1 in a year and as long as your 5yr ban is over at the time of your interview you will get approved!  

unfortunately, yes Canadians were allowed D/S. Im really surprised he didnt just allow you to withdraw your applicaiton! I know lots of canadians that had that happen to (basically incurring no ban).  i know so many canadians that have had this happen to as they are unaware of these laws and think you can just go back and forth with no issue.  what you need to do now is really deicde "should we apply for the CR1 now and then use a waiver and get to the USA in 2 years or should we just wait until 1 year left in my ban and thena pply"

 

if you want a great waiver lawyer call Lizz Cannon! you need a waiver SPECIALIST someone who literally does 10 waiver cases a week and that is all Lizz Cannon works on! so call her and she will give you a free consult. but like the other posted said, nothing can speed this up!

Is there anyway you can give us more information on to how you know this to be true?

I have gone through this experience at the US/Canadian border in 2014. I do not mind it when people speak in absolutes when they work for USCIS or are going through it themselves but sometimes you might have to accept that things are not always the way you experienced them.

This site can be helpful but a lot of the moderators are really closed off and quick to know it all one liners which are not helpful.

The US does not have exit controls, you leave. Done it enough times.

They do check people coming in.

Seems fairly clear an I212 is needed, not enough info to comment on I601.

the person never got deported just left on there own and went to cross again and the USA questioned and obviously found out they were 'living' in the usa and imposed a 5yr ban.  that is a 601 waiver! regardless, i wouldnt suggest doing a waiver on your own as you have to prove hardship and i would suggest going to immigrate2us.net (i believe that is it) as that is a waiver specialty board!  like i said talk to lizz cannon or another quality waiver lawyer - i called LC before and she gave me valuable help on my case for free.
