Notice of intent to deny... what?!

Hi guys! I thought i'll start a new topic because i want some opinions.

For details please see my signature.

First of all i want to say that our marriage is real. Seriously.

Today, December 27 2016, a year and 4 months after our initial interview, we had a stroke interview. The interview was about i-130. What did not match:

1) I have a day time job and i sometimes babysit for my neighbor, i didn't babysit for over a month and i don't get paychecks from this so i didn't even think of mentioning it, but my husband mentioned it. We both names my "main" job correctly.

2) He has two different positions at his job, i was asked how much he makes, i remembered how much he makes at one position but forgot about the other, i did say that he makes more at the other but i don't remember how much. He just said he makes xx$ as *his second position", since he works this the most.

3) i totally forgot his appendix scar, i did name other stars/tattoos. He named all of mine as well.

Thats it. Everything else was perfect and these mismatches can be easily explained (we were not given a chance though). At the end the officer said that she will send a Notice of intent to deny. I don't get it, neither does our lawyer. The lawyer asked why, but the officer said to wait for the notice. The lawyer thinks there might me something else on i-130 but there is really nothing, i can't think of anything. Besides, if there is something else, why wasn't it brought up at the 2nd interview?

So, do you think we will get the notice just because of those mismatches? Anyone else was in a situation like this, i mean when it was a real marriage, no law violations or anything like that?

We did submit evidences (joint accounts, lease, bills,photos, plane tickets etc). Twice, since out case was forgotten about (or lost?) - see aug 9 2016 in my signature.

There must be serious reason for stokes interview on the first place. What was it?

There absolutely wasn't. We were not even asked that much at the 1st interview, we were really surprised that we got 2nd.

We had a lawyer who was taking notes of our answers during the 1st interview, and she had those notes, our answers were acceptable.

Sounds like they definately know something you don't or they found something somewhere... having a Stokes interview definately is not a good thing.

The other thing is, strokes interview was too easy. It was very quick and most questions were about out apartment: where is the mail box, how many locks you have, how many bedrooms ect. Easy stuff. Where we spent christmas eve, what we had for dinner yesterday. I even asked if thats it, i thought it will be harder. Thats weird that they didn't talk about "what they found". I don't know.... unless my husband is hiding something serious lol but they asked him the same questions. The lawyer was there.

Definately seems odd in sense of the 'normal' Stokes interviews that you see/hear about that are very intense and specific about a lot of things... something in your paperwork or from the first interview obviously has made them very suspicious and doubting of your marriage...

Yeah... i really wonder what it is. Hopefully she will send the notice today and we will get it by the end of the week.

May be the officer doesn't like me personally and decided to use those 3 mismatches. Before she started the interview she was explaining that if she can't approve she will sent a NOID and i said that there is no way she will have enough evidences to do that. Well, i was really annoyed and mad because of the long wait and now the 2nd interview out of nowhere, so i was giving her a little attitude i must admit. May be she just decided to give us a hard time.

There is a reason for their disbelief, you just have to find out what it is.

Consider filling a FOIA request to obtain your complete alien file. It's possible there is some clue hidden in there as to why USCIS does not believe your marriage is genuine.

Yeah, he did. They didn't ask anything about that though. Neither does our lawyer thinks it could be a reason. Unless they found something in their file? Will they have to prove again that their marriage was legit? All during the 30 days we have to respond to NOID? Thats crazy... it was 12 years ago... and everything was checked already since she got her citizenship in 2012.
