Timeline

Hey, jerseygirl. My K-1 wife and I are also in NJ. We got married 2 weeks ago and went to 2 different DMV offices. They both said that, since we are now married, the K-1 visa status no longer applies. They also said we can't get a DL until we have the EAD. We just filed our AOS application which should take 8-12 weeks for the EAD. The problem with NJ is they say one thing on the phone but something else when you go in person. Maybe a different office would help; we went to Lodi and Wallington in Bergen County. Good luck...I know how frustrating it can be. My wife is DYING to drive because she drove in the Philippines all her life

Our plan was to fo to Rahway MVC but since I got your response.

Alright, so might as well wait for the EAD/AP combo card. I just thought once we have completed the 6 points verification - my husband can apply. anyways, we are waiting for the combo card EAD/AP since our NOA1 for AOS was Oct 11. Hoping and wishing for it to come sooner so that my husband can get his DL and as well open bank accounts here in NJ.

Waiting process again.

Hopefully for you, since you got youe NOA 10 weeks ago, you SHOULD receive your EAD/AP card very soon. Did you get your biometrics appt yet? In any event, hope things go smoothly for you. Please let us know what happens when he gets his DL, if you don't mind. The uncertainty is the hardest part after the waiting. Thanks and enjoy the holidays!

Yes. Biometrics done since November 17, 16' then we got an RFE December 8, 16' but sent back a reply days later. Yes hopefully. Current status online was RFE reply received. I read a fellow member indicating that the online status is kinda sketchy when it comes to the processing. People who are updating the online may sometimes be in delay to update a movement in the process.

It is unlikely that any DMV will allow you to obtain a license or ID without an EAD once your I94 has expired. The earliest you should be able to get one, is once you have your EAD + any other documentation they might ask for.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
