oGenius2003 if you  are filing Vawa you don't have to file l130, you are a self petioner of the form l360. 

 

When I said USC IS cannot adjudicate  (decide) about your  AOS  is because you are in removal proceedings, who is in removal  must choose or USCIS  to adjudicate  (to decide) and then must have the removal closed or terminated, or you  can choose to  adjust  status in the  immigration Court.

 

In my opinion an USCIS officer is more amiable   than a Judge, but  you  hAve to discuss this with your  attorney.

I think those processing times stop being accure the moment you get a RFE.

It normally takes 3-4 weeks to get the receipt notice and prima facie within one month or sometimes more. don't worry you're not alone xx

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

Don't worry. I was waiting for my receipts for over a month. Vermont Service Center seems to be backed up, I assume due to the holidays. Wait patiently. If you do not receive a receipt within 30 days you can have your attorney call the Vermont service center for the receipt number so you could at least track it online.

May be it's best you ask your attorney to give you the tracking number and take matters in your own hands to find out soon enough.
