CR-1 denied under 221g in Ghana. NOW WHAT?

So sorry to read about the denial. The process now, if you cannot get your congressperson to intervene to immediately get another interview before the packet leaves Ghana, is that your file will go back to USCIS. That will take 6 months. Then, it will take another 6 - 9 months of it being at USCIS before you either get an NOIR / NOID stating exactly what the issue is, or your file will be re-affirmed, in which case it will just go back again to the Accrra embassy, through the NVC.

Why everybody is focusing and asking for how long she visited. Someone visited for 14 times and sent in tons of evidence but they still got denied.. They check the realistic of your evidence. How you edited your Facebook, whatsapp, viber , imo whatever instant messages.your facebook, whatsapp, viber etc must have your real names.. You can provide house documents without pictures of the house? They might not believe it. They do investigations. Your Facebook account also count . Once you provide fb messages . It included your Facebook username and that of your fiance, wife or husband. They'll use that usernames to look for you on Facebook to check on your profile . Have a real informations about you on facebook. Your Facebook name should be your real name on your documents. It also count . Do not hide information on facebook. On my K1 interview, CO asked me, how many Facebook account do I have? You know why? That's because I kept changing my Facebook username to nicknames. My answer to the CO was 1 but I keep changing my Facebook name. SHE said I found that had to believe. Dates on your evidence documents ? When did you get those documents signed. Is it when you started the process of your petition is when you started getting those documents for them to believe you? No they will not believe that . For example; You got your husband / wife or fiance on ur life insurance today and sent in with the petition in a week time. That means you did that because you want them to believe your relationship is real.they have softwares to detect every false documents. False documents willl lead you to automatically denied . Putting in different information on CR1 forms other than what you had on your k1 visa forms will lead you to automatically denied .

Yeah, you are right. The two visits can get them denied . What about someone too being visited for 14 times but still got denied ? There must be a problem somewhere. I have a pastor friend in Minnesota. His wife visited for 1 time and they got married in that first visit . No engagement. But he got approved for not seeing each other for 3 good years after the marriage. Face time count but not in all cases..

So sorry to hear of your denial. Many things here come to mind. First, In this case the visits matter because you also have a 12 year old teenager. You are suppose to be bonding with. And that can't be done over Facebook and chats. face time is vital. It's not just about the husband.

Also what of the mother? Is she still in the child's life? Did you get a affidavit from her giving her blessings for her child to leave her? How much she is in the child's life is also vital.

I have seen cases where they did send field agents out to investigate they interviewed people, neighbors, friends. You would be surprised what people say or what their perception is. Think to your self does your husbands neighbors know about you by name. Can they say "Oh that's XXXX wife we know her see her often with the child. No one else goes in that house but them".

I have seen parents questioned saying "their son had girlfriends". Well not good when you the wife. Neighbors saying they never seen the petitioner didn't know the guy married even.

I know I lived with my husband 6 months seen by everyone. You could go anywhere we went in Enugu and anyone knew who I was, and who I was married to. Seen washing my clothes hanging them, cooking outside, playing with the kids, visiting the market. There are all things they may have looked at.

The issue you have is you were denied and married and filed without investigating why. If they think it's not real after a denial, marriage and a new petition I suspect it may be the mom, and lack of visits.

You need to request the FOIA (Freedom of Information Act) get the notes of the CO from both the I-129F and I-130 interviews. It will take a while but you will be waiting awhile anyway. Get your ducks in a row and get in front of this NOWISH.

Sorry you have to go through these denials.It is mere speculation at this point so you have to wait until you find out through the NOIR

what the critical points are. Ask your husband to go through each question again and what the CO focused on when he has settled down

from the bad news. In doing so 9 times out of 10 you get a feeling for what the problem may be, though indirectly.

You have done the right thing to contact your congressman for a review and to inquire about the reason(s) for refusal.

That does not mean they will tell him but it's worth a shot.

Look up FOIA and file it but make sure you are very specific with the request or they will be

so general in terms of refusal and you still won't know. Make sure that you and your husband sign the privacy release on the FOIA

form or they will not be specific to protect his privacy.
My feeling is that a field investigation has taken place and information come to light that made them decide your relationship is not

bone fide on his side, just assuming though.
It will take about 9-12 months to receive the NOIR letter and you will have 30 days to respond to it so be ready with evidence

to dispute their points.
No one can speed up the process, it will take time.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

The CO’s in Accra are very notorious for 221g AP; they have less time to review all the submitted evidence and usually make decisions without all the known facts, I hope they move all the officers in Accra very soon, they tearing families apart daily all in the name of 221g (meaning we will give you the visa next year if we feel like giving it to you)

 

At this point “TIME” is your only friend, the embassy is Accra will cease all communication with you moving forward, they will claim they can’t comment on your case because, the case has been sent back to NVC to be forwarded to USCIS, but that is a lie. Cases can take as long as 4 months before leaving the Accra embassy.

 

Now talk to you husband and get all the 5 questions he was asked and figure out where the errors originated, and try to find evidence to battle that in case they request for more evidence, be ready because if they do need more evidence you will have only 30 days to submit them.

 

Now once your case arrives at USCIS after 120 days without communication get your senators office involved, congressional inquiry about your case can speed up response from USCIS.

 

Also pray your case is not sent to the Nebraska office that is the slowest process facility in the country.

 

But for now all you can do is pray, be very patient and TIME should be your best friend
