I need help on i130 withdrawing

I file i130 and was deny during interview and case sent back to uscis,now I was advice on vj to withdraw and refile again,my online case statue updated 2days ago as case return,but they(uscis) said Thier computer have not been updated,now I want to file a new petition after sending a withdrawal letter 7days ago but no response from uscis if they get the withdrawal letter we sent but the customers service said we should wait for the confirmation.of case close before filing new one otherwise the new one will be rejected.have anyone been through this?I need your help to know if I can file awaiting this letter from uscis confirming case withdraw.thanks

How is filing a new petition going to overcome the issues with your current petition?

the issue with the old one is that the married certificate was not accepted as legal married and we went to do it properly as demanded.that is why we withdraw the first petition and want to refile again with explanation why we withdraw the old case

there is nothing to withdraw if your case was denied. What was wrong with the marriage certificate?

If they denied you because your marriage certificate was deemed invalid, then I hope you married again and have a valid marriage certificate before re-applying. Otherwise, you are going to get denied again. You can't explain your way out of invalid.

I would not wait for confirmation. It can take 6-8-10 months to get that. Include a cover letter with the new petition stating that you sent a letter to withdraw the first one. Don't listen to the Misinformation Line (=USCIS Customer Service Line).

there is nothing to withdraw if your case was denied. What was wrong with the marriage certificate?

embassy returned it to uscis because we married in dubai and the church was unable to get us a married certificate because it was not a registered church with dubai government so the pastor went to my country to provide idea us with a register marred certificate from married registry and the CO refuse the visa on the ground that we were unable to provide a married certificate in the country where the marred took place but we lafter went to nigeria and do the married properly

You can put a copy of it, if you want, just make it clear in your cover letter that it was already sent and the one there is merely a copy.

I agree, add the copy of the withdrawal letter to the new petition, list it on the cover letter and write a new letter that you already requested

the withdrawal on date___and that the copy is attached. Make sure the petitioner's and your name, DOB and case numbers

are on the letter and keep it on top of the package.

No need to wait a year or so until they acknowledge the withdrawal letter.

State the reason why the case was denied on the letter and that you corrected the issue and have a valid marriage certificate now.
