she will enter on PR visa...currently going through the process with embassy to have PR visa granted...Thanks (she also holds visitor visa from previous but now she will be getting PR...)

Confirmed that father is India and will be 'visiting' and then adjusting.

I've gotta agree with the others. The original post was confusing so clarification was requested. In the clarification, it became clear that the father is not in the US yet but will be visiting on a tourist visa. Once inside the US, he plans to file for AOS for him. It is fraud to enter the US on a non-immigrant visa with the intention of immigrating.

First she says "my parents are here on visitor visa."

Then she says that she sent a I-130 for her mother and is in the final stages of processing. She thought that her father could be included as a derivative, but later found out he needs his own I-130, so the plan is to get the mother an immigrant visa and have the father come in on a tourist visa WITH INTENT to adjust to PR.

I smell a TROLL.

Why are some people almost always "protecting" individuals who are clearly committing / about to commit fraud, I will never understand.

OP. If your parents are not in the USA, do the right thing.

So the fact that OP clearly states that she's about to commit fraud isn't good enough for the forum members to tell her that she's doing something wrong. OK. Yeah, I know we're not immigration officers. But we are here to make people know that they are about to do something illegal.

(I think its time to sign off from the Visa Journey. The adoration corner for all the people who loves to cheat the system is too strong and too annoying for someone that do their best to work on their immigration path in a legal way. Not only talking about this topic. It happened many times.)

I don't know why people keep screaming "fraud". This is legal loophole of the immigration system. For now they can legally adjust their status. This is not people's fault but immigration laws fault. Should they close this loophole? Maybe. Do you think USCIS do not know it? If course. Who can believe that an individual visiting US for 2-3 weeks, madly falls in love, gets married, suddenly leaving everything behind in her/his country? Zero chance. Same for parents. This is why I do not think this is fraud.

But it's not a legal loophole...it needs to be legal in the first place for it to be a loophole. Entering the US on a tourist visa with the intent to file for AOS once there is fraud. This is the individual's fault if they falsify their intent on the visa or at POE...not the laws' fault.

Is it something like that,

1) Mother can stay in US as she has PR visa.

2) File i-130 for father(not sure it can be done after entering in US or from home country) and till the time it approved her father can travel on visitor visa ?(6 months come and go back)Is that legal?What's the legal immigration law for AOS?

How can we guide/help her to do it right way? what's legal process?

Isn't AOS is depend on i 130 approval.If she file i-130 before her father visit US,it will approve in 3-4 months and then AOS.Is it legal?

You turn up at the PoE and they ask you what is the purpose of your visit.

So what does her father say?
