Tourist Visa for Father in Law in Morocco to visit US GC Holder Family

Hi VJ,

In the past my sister in law applied for a tourist in the past for her father and he was denied. I was wondering now that my husband (my sister in law's brother) is here in the US with a 10 year GC and his sister is working on becoming a US citizen... what can we do to make a strong case for my father in law to come visit and be approved for a tourist visa?

In addition what should we include in our letter of invitation to my father in law to help at his visa interview?

there is nothing you can do, he must apply on his own and show strong ties to his country

convince the officer that he won't stay and adjust status

he has family here in the future that can petition him, he can file for adjustment of status once his daughter becomes a USC, so having family here goes against him

he has strong ties to stay here, immediate relatives that can file for him once he's here

he must overcome this on his own

A strong case for approval requires your father-in-law to overcome the presumptions that all visa applicants intend to illegally immigrate to the US by demonstrating strong ties to home. His children being in the US does not help show his ties to his home. His children are ties to the US and are reasons for him to stay illegally. Your FIL needs to show why he would return home if granted a visitor visa. His reasons for coming to the US are irrelevant. His children will not help him get a visitor visa.

Your FIL qualifies for a visitor visa based on his circumstances only.

An invitation letter is not considered in granting a visitor visa. This is US Embassy policy.

He has to overcome the presumption of immigrant intent like all visa applicants do. Someone's GC or citizenship has no effect on another person's B2 application.

In addition what should we include in our letter of invitation to my father in law to help at his visa interview? Letters are almost never looked at by embassy consular staff.

My father in law still has his wife, 3 other children - one is differently abled and unable to care for himself at all in Morocco in addition to his two children that have now immigrated to the US. I would think that would show strong ties to Morocco and no intent to immigrate to the US or desire to stay illegally - which he does not because he knows it would mess up any chances he has in the future of immigrating legally.

What are ways that my father in law can show his strong ties besides family etc still in Morocco? Could you give clear specific examples?

Show that he owes property, has a job, for example.

Basically anything that would force him to return home would be considered a strong tie. Families be abandoned - as I was told by a CO once - so they want to see if you have property, a job that they have been established at for sometime, bank accounts etc.

She basically quoted the foreign affairs manual - which you can read online. My husband structured his answers based on this with proof to back it up when he applied for a visa to go on a cruise with me. They still said no. So just hope for the best for him.
