the certificate will file with was not register in dubai where the marriage took place but the pastor went to nigeria marriage registry and register it there and the consulate insist that why can't the church where will marriage can't provide a marriage certificate?in that case the CO disagree not recognise this certificate and this is why we went to nigeria and get it done properly

Relax while you proceed with all the advice you have received in here. You really don't need a lawyer for all you intend doing, read the guides and wiki above, and research in here, you will see someone who has gone through a similar issue in the past.

thanks I told my wife that lawyer are not more trained or educated than those in this forum ,that we should withdraw the old one and file new one but she said the lawyer said we should file a new petition and the total cost including Financial support preparation is 2700 dollars,so I am thinking that we do not need a lawyer for the first petition but this petition.might likEly involve a lawyer because of the first case that was sent back

thank for the promptly reply,in the first case we look for the first lawyer who earlier told us to refile as the time for appeal is long and if appeal fail we ve to start the process again ,this is not the lawyer who charge us 1500 dollars and promise to respond to NOID. secondly,it came as a surprise to me when I find out the church won't be able to issue me a certificate as the pastor said for all the previous married he conducted were registered in Nigeria,I doubt if the certificate is legit but this is the same certificate we were file with and got approved and my wife use it to change her name and the CO insist on the church certificate but the church is not registered in dubai and can't issue a certificate that dubai govt approved.when we find out how the CO insist on the church certificate and we can't get it,we ve to go to Nigeria and have it done properly and after that I email the embassy and they asked me to bring the original ,we did and case still sent back

my petition was deny in US embassy abudhabi after been in AP for 6months,I got married twice as the consulate refuse the firSt marriage certificate that I use in filing,I married in dubai church but the church could not get me a marriage certificate because they are not register with dubai govt,the church register the marriage with nigeria register which provide us with a marriage certificate and the CO disagree,we went to nigeria and re married in a proper way,now the case has been sent back.I was advice on vj to withdraw the case and refile,how can I withdraw it and what is the chance of getting approve the second time?and what reason can I give uscis for the purpose of withdrawing this i130?thanks

the fact is that we married in dubai church but the church is not registered in dubai to conduct marriage ,and if I was told before the marriage,I won't risk that,due to this ,the pastor now go to Nigeria and get us a marriage certificate with nigeria marriage registry which the CO insist that we married in church in dubai and the church in dubai need to give us a certificate,after knowing all this we travelled together to nigeria and went to federal marriage registry and get the marriage done the second time.hope this is clear.thanks

The pastor did, but when the CO didn't accept that, they actually went to Nigeria and got married there again.

OP, in your new filing make sure to only use the date of the marriage that occurred in Nigeria when you both went there in person to get married.

thanks for the advice ,I will do that but we are trying to get a lawyer becasue we never understand how to answer that questions which will be on the new i130 that we have deny before. becasue we have to also withdraw the deny petition,lawyer charging us 2700dollars for the whole proceses

Just say yes and attach an explanation. No need to waste $2700.
