Work Visa what documents are needed ?

I am trying to get my finance here from tunisia. I am not divorced yet so no K1 right now. We will use the work visa since I can hire him in my business.

I would like some advise if anyone can give me some ideas. This is what I plan to do with all proper forms of course

I will advertise in all of the national and international papers. The job position that is needed is very difficult to fill. We will be accepting resumes and I will hire him from tunisia who is the only one with all of the qualifications.

What are all the documents that will be needed from my company and from him ? This is a permanent position, I have been told he can stay indefinite, and if he decides to do some other work, I dont have to hire him....has anyone heard of this before ? you say you will advertise the position on job boards but it is difficult to fill so you will hire him? why even post it then you are not even trying to meet the requirment of looking in the us for people to hire.

then there is the issue of only allowing a certain number of visas (lottery as to who gets it) a year and requiring certain types of degrees.

good luck hiding the conflict of interest during the visa interview. (going to go work at a company your fiance got you hired at is a bit of a red flag)

Work visas are for hard to fill, temporary positions.. for workers not easily available in the US.

So you want to pay thousands of dollars to bring your foreign boyfriend to work for you and once your divorce is finalized you will marry the "help" ?? Can you prove no American can do the job you are hiring him for (obviously there are certain jobs he will be doing behind closed doors) do you honestly with all do respect think this plan will work ?? Just wait till you divorce is finalized and do a k1 like most people do less problems that way unless you want a huge red flag all over his immigration process

You need a lawyer; work visas of the permanent/ long term kind you talk about are filed via a lawyer, who will tell you what sort of papers you need. Also be aware of the cost, which is $5000+

How long till your divorce btw? Waiting and then filing for a K1 may be faster, and will be significantly cheaper too.

Thank you all so much for your input. I am surprised an attorney would not know these things and seem like they can make this happen. This attorney is one of my relatives, successful and I dont think out to rip me off so I dont know what to believe but for now i am backing off until I feel good with my decision,

Is your relative an experienced immigration attorney well versed with work visas and their nuances? Obviously not if he/she is even suggesting that it is even remotely possible for you circumvent the immigration rules in order to get your fiance here. Work visas are reserved for people in specialized fields(STEM) when a US employer is unable to find an experienced US citizen or legal permanent resident to fill said position. You haven't done your homework and just because a relative who happens to be an attorney says you can do it, doesn't make it so. If it is quite clear to us that what you want to do is not on the up and up, what do you think a consulate officer will think? Your only real options are either a K-1 visa or getting married in his home country and applying for a CR1 visa. Good luck.

In defense of the OP, I was told all kinds of ideas by a few people about how easy it would be to bring my gf (now wife) here without a spousal or fiance visa, mostly around creating an LLC shell corporation, hiring her, and then filling out some simple paperwork, thus enabling a work visa. Of course, once I further investigated these schemes I rejected them out of hand. Seems like that's what the OP is doing.

Also, let's not get on any high horse about the diligence of US companies in bringing people here on H1b's. I've watched Dow Jones Blue Chip technology companies pull some pretty shady reasoning to justify bringing in cheap labor from India to do jobs that the American workforce is fully capable of doing. In the end, the requirement for seeking out and not finding skilled labor in the USA is just a checkbox that these companies navigate easily.

Not just Dow Blue Chip.. tons of small time shady consultancies, many owned by Indian americans who bring in cheap labor from India on H1bs, often with money changing hands under the table.

These companies have high priced lawyers to write justifications on why they need to bring foreigners to do the work.

I too have heard stories on how easy it is to hire someone and bring them over to work. Little did they know.

OP, nothing against your lawyer. They probably just didn't know thoroughly of the requirements. We see it all the time here on VJ pertaining to lawyers. That is why it is suggested to get competent IMMIGRATION lawyers.
