Hi all, I'm completing the affidavit of support (form I-864) and it says I can send the past 6 months worth of pay stubs to show my income. I want to do this to show I can support my husband. The problem is that I just now noticed my marital status as far as taxes is listed as single because I forgot to update my W-4 after getting married (about 9 months ago). I get direct deposit and my pay stubs get e-mailed to me but I never look at them because I'm salary and the amount deposited into my bank is always the same.

I researched online and I can't find anything that says not changing your W-4 is illegal. However, my concern is that this will be a red flag for immigration. I don't want them to think that my marriage is for anything other than love. Does anyone know if this matters? Should I just not send them? I'm already sending the tax transcripts, per their requirements. I would rather just send more and have it not be needed than send less.

What your payslip shows, other than gross salary, is not relevant for the purposes of I-864. What is far more important is filing taxes jointly when the time comes. It will be very difficult to explain anything but "married filing jointly" to USCIS.

On another note, you're giving the IRS an interest free loan by getting taxes taken from your pay as a single person.
