Yes, if you are physically present in the US and were inspected in a port of entry or border, with a current legal status, you can submit I-485, I-765 (for EAD) and I-131 (for AP). If your date is before the one posted by USCIS. For this month and next, it is the Dates for Filing (Chart B).

Yup.. Thank you..

BTW.. last i heard is someone from DEC 1st 2016  got 130 approved from california SC   !!!!  any latest approvals guys ?

I see. however it could also be a USA citizen applying I-130  for a family member ..

not sure if that makes any difference ,however its good to know DEC 8th is the latest approval.. my PD is DEC 7th

By looking at the user profile its looks like F2A. We can check that in F2A Visa TImelines.

Does anyone know,approximately.. how long does it take to get an EAD after its applied upon 130 approval..

while the individual is present in USA

If you follow the threads in the AOS section it looks like anything from 3 to 7 months. The usual processing time should be 3 months but it has been getting slower slower.

OH NO.. i hoped atleast the EAD approval went quick..

it sucks to wait on these.. couldn't change the employer.. have to stick with H1B

and not many employers are ready to employ a H1B.

once 130 approved.. do we get notified by mail/email ?
