Greencard approved in 58 days!?!

Timeline

Has anyone see other stories like this on VJ?

I checked the status on Thursday (10/20) and it said "case was received" for EAD and AP. But on Monday afternoon (10/24) when my father in law checked it said the following....which we couldn't believe- as it was approved on day 58 from NOA date - and that in Newark, NJ which shows about 200+ days on VJ timelines. So I called USCIS this morning at 8am when they opened and they said the GC was approved! And we should be receiving a letter saying that soon and production of Green Card should be ordered and sent out to us.

485 (Green Card):
On October 21, 2016, we approved your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSCXXXXXXXXXX. We will mail your approval notice. Please follow the instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address
765 (Employment)
On October 24, 2016, we terminated your Form I-765, Application for Employment Authorization , Receipt Number MSCXXXXXXXXXX, because the applicant or petitioner received a status or benefit through other means. We will send you a termination notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.
131 (Travel):
On October 24, 2016, we terminated your Form I-131, Application For USCIS Travel Document, Receipt Number MSCXXXXXXXXXX, because the applicant or petitioner received a status or benefit through other means. We will send you a termination notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.
BTW, don't look at my timeline on here because that is all from my wife's K1, AOS, ROC, USC journey, below it is for my in-laws. We did use a lawyer to help us with this application. And my in laws originally entered the US on a tourist visa
AOS/EAD/AP:
Sent to Chicago Lockbox: 2016 8-12
Mom: AOS/EAD/AP NOA1: 8-23 (text on 8-23; received letter on 8-27)
Dad: AOS/EAD/AP NOA1: 8-24 (text on 8-24; received letter on 8-29)
Mom/Dad: Biometrics Appt: 9-22 (received 9-10)
Interview Appt: never happened!!!

GC approval: 10-21: Website says "Case Was Approved" Notice mailed welcoming the new permanent resident.- DAY 58

EAD: 10-24 - Website says "Case Terminated Benefit Received By Other Means"

AP: 10-24 - Website says "Case Terminated Benefit Received By Other Means"
GC approval letter: xx-xx (letter received)

GC received: xx-xx (Date on GC is xx-xx) - DAY xx

Did you file a concurrent AOS case? Those have a mandatory interview. I think something is wonky.

Did you file a concurrent AOS case? Those have a mandatory interview. I think something is wonky.

What do you mean concurrent AOS? We filled 485 for both parents at the same time along with 130 (Alien Petition) and 785 (Work) and 131 (Travel).

I mean what you did, I-130/I-485 AOS.

I agree this doesn't sound right, first on the speed and then on waiving the interview for a very suspicious situation. How can in-laws adjust status from tourist visa? How do you prove they had no intent to emigrate to the US, seems like the clearest case of intent. I'm guessing that the lawyer advised to do this instead of doing it the legal way.

Yeah that's what I don't get. They arrive for a at-max 6-mo visit and then 'suddenly' decide to AOS.. and approved with no interview?

No, they could have been living here illegally for a long time.

Based on a general understanding of my Indian colleagues, highly unlikely the in-laws entered on a B2 and overstayed for a long time; i130 likely filed prior to i94 expiration. Perhaps OP can correct the assumption and offer a different timeline.

Maybe but either way it doesn't matter. Parents are immediate relatives and intent alone is not a reason to deny. If they lied at POE that is a different matter.

Timeline

As for Adjusting of Status, one lawyer I was in contact with even recommended to obtain a B visa, and he told me, to tell the embassy, that I would want to use it for Adjustment of Status. I told him that this can`t work, and she informed me on several cases, where the person ask for a B-visa for adjusting of status, was granted it, and did AOS in USA. Thus, I think this "issue" with adjusting on B-visa is a bit overrated on VJ. Obviously even Embassies have not had a problem with it. I have not done it and will never take the risk, but just mention, that lawyers advise to do it, and even embassies accept it.

I can certainly believe that an underhanded lawyer could get you to try, but I don't believe for one second that any US embassy - anywhere - would grant anyone a B visa after you had told them you intended to use it for AoS. Embassy staff are expressly prohibited by law from granting a B visa under those circumstances, so that's 100% bs from that lawyer.

As for the OP, it's not possible for AoS to be approved from a tourist visa without an interview; they are mandatory in those circumstances. It's a USCIS error.
