Questions to filing I-751

Hello All,

I am U.S. Citizen and my wife is currently Green Card with Conditions (she got her greencard based on our marriage)

My wife and I got married back in May 2014 and she got her green card in February 5th, 2015.

Since it is almost time to start her I-751 to remove the conditions, we are beginning to work on our package.

Few questions.. when I tried to download the i-751 form, I saw below instructions on it, it states as below..

"You and your spouse must apply together to remove the conditions on your residence by filing Form I-751. You should apply during the 90 days before your second anniversary as a conditional resident. The expiration date on your green card is also the date of your second anniversary as a conditional resident. If you do not apply to remove the conditions in time, you could lose your conditional resident status and be removed from the country."

1.Do we need to file 2 separate I-751 for each one of us? and also pay two filing fees ($505 x 2)?

Or do we file one I-751 under my wife's name?

2.Since her green card's 2nd year anniversary is on the February 5th, 2017, should I send the file exactly on the 90 days before which I am assuming on November 7th?

3.Below are what we can provide as evidences for our marriage.

A. marriage license,

B. photos,

C. airplane tickets (we traveled ALOT internationally),

D. our joint car insurance,

E. joint checking account,

F. joint tax returns,

G. joint credit cards(wife being Authorized user),

H. wife being the beneficiary of my life insurance(company paid for and I have to look for this document),

I. our 5 month old daughter who we had in May 2016, her birth certificate stating myself as the father and my wife as the mother,

Other than these, we do not have much more than this... is this enough? We live with my parents and I give my parents money(cash) monthly so my parents can pay the mortgage and utilities, etc... Any other recommendation for evidences? Can't think of others..

4. Lastly, are interview must for all i-751 applicants? We are asking because we get super nervous and I heard some people bypass the interview and gets approved for removal of conditions.

I am just little worried about the process because the trouble some we had when filing for her greencard two years ago (Mailman failure to deliver our interview appointment letter causing denial to our application, etc).

1. Only file one form I-751 and pay one fee. There are spaces that both your wife and you will fill out & sign.

2. Mail it on the 90th day to make sure it does not arrive too early.

3. Your evidence sounds pretty good. You might want to have your parents write and sign a letter stating that you pay them monthly rent and you both live there together.

4. Most people do not have interviews for I-751. Interviews at this stage are for people with little evidence of a bonafide marriage.

Nov 7 does sound right for the beginning of your 90 day window. Your application package should not arrive before Nov 7. Your wife is the conditional resident (petitioner) removing condition. So only one I-751 and one fee. Information about you (the US citizen spouse) goes in Part 4 of the form.

Your list of evidence is already quite good. You may want to add the following:

1. Copies of DL for both of you on the same page showing you share the same residence.

2. Joint Health Insurance.

3. Will

4. Health Care Directives

Remember the application fee for I-751 is going up on December 23, 2016. So apply before that.

Your evidence sounds fine except proof of living together, i.e. a lease, title, or statement that there is no joint lease or title and other proof. A statement or lease from your parents would help.

The marriage certificate isn't needed. Boarding passes and passport stamps are preferred proof of travel as well.

Quick question.. I've been going through some posted and some people were saying I would need to send Tax Transcript from IRS because printing copies of Tax Returns from Turbotax.com would not work.

I don't recall sending my Tax Transcript from IRS during AOS.

Is this true? Kinda freaking out now.

Nothing to freak out about.

They tend to prefer tax transcripts. You may want to get those and have them ready in case you get a RFE. You'll also want to get a tax transcript after filing 2016 taxes. I know a number of people this or last year all got RFE for new tax transcripts before their ROC was approved.

Tax returns require copy of W2s, etc to be sent with them. Tax transcripts can stand alone and are an actual print out of what you submitted. Both are ok.
