hi, my case got approved with USCIS. I would like to know the tax filing process. Here is my case scenario. My husband is the petitioner (US born citizen). He has been working and living abroad since childhood. From past 3 year that is 2013, 2014 and 2015 he was working in Doha, Qatar and from May 2016 he moved to US and has a job there. He never filed taxes while abroad.

My first question is how to show the tax returns of the most recent year that is 2015 as mentioned in form i864.

Second question is since he is working in US since last 6 months only, how do we prove that he is meeting the 125% poverty line. Do we need to show the employment contract and salary details?

Any help would be appreciated

Your husband can backfile taxes as a non resident for the last 3 years,.

For the current income, he can provide paystubs and a letter from his employer stating the salary, and that then job is stable and long term.

Either 1040, or 1040A or 1040EZ, if you don't have a lot of deductions/credits.

BTW- Your husband MUST file the missing tax returns. He can't not file just because he worked/lived abroad.

any idea which forms we need to file for our particular case?

If you are absolutely clueless in this manner, engaging a CPA or tax software might be of help.

3/2/18  E-filed N-400 under 5 year rule

3/26/18 Biometrics

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.
