My name is Caitlyn and my husband and I have been married for almost two years now. My husbands name is Temo and we met back in our second year of college here in the United States. At the time he was here on a school visa and playing soccer and I was attending the same school ( also playing soccer). As time went on we decided to get married and he ended up not renewing his school visa and he has been over staying since. I'm currently still in college and he has two great jobs in the town that we live in, my question is, what now? I'm 23 and he's 26 and we are wanting to move forward with his green card application but are really hesitant on where to start and the costs. Obviously I would be his sponsor but I'm afraid that they would look at my application for him and immediately turn it away because I'm clearly still a student and don't have a "real" job at this point in time. Should I go ahead a file concurrently with both forms and can we do this by ourselves? We are in the process of looking for an immigration lawyer in Texas, so if anyone has any pointers at which path we should take, or if you're going through the same situation, any information would be helpful at this point in time. We are starting to lose hope!

You're very right... football it is. And thank you for that! It's not hard finding jobs, especially in small towns such as ours where dairies and agriculture is.

Don't let the fact that you're a student hinder you from going through with the Adjustment of Status process. It is 100 times better to start filing now than to risk your husband getting caught by immigration and deported/given a bar from returning to the U.S.

As far as you being a student, I think we were in a similar situation. At the time of filing, both my husband and I were undergrad students. We had both just completed an internship where we didn't make much money. This was reflected on our most recent joint tax return. After finishing the internship, he got two jobs, and for a few months, we lived from that and money that I had saved up from the internship. While it was recommended, we did not use a joint sponsor. We were a bit under the poverty line in terms of income, but we had proof of money saved in the bank, as well as two cars, which means we could use the value of one of the cars as an asset. Once I got my EAD, I got a job. For the interview, I had copies of every document we had already sent, as well as a new Affidavit of Support which also included my income as well. I offered it to the immigration official and he said he didn't need to see it, as he was content with our original submission!

NOA Received by Mail: April 7, 2016

Biometrics Appointment: May 10, 2016

Biometrics Walk-In: May 9, 2016

Interview Scheduled: July 14, 2016
