Hi there! So my girlfriend is a citizen of the UK, three months pregnant, and I am American. We planned on doing a K-1 but with the surprise kid we don't really know how to handle getting her here. We want the baby to be born in the US ideally, but time is pretty short, and we don't really know what the best option is now. Can anyone tell me what the best way to handle this situation would be? Is it at all possible for her to get here to stay before the baby is born?

I'd reconsider having the baby born here. It cost 20k+ in the US, while in the UK, you don't have to pay. You could go over there for the birth. The child will be a USC either way, but if born in the UK, you'll have to file for CRBA and US passport for the baby.

Have you filed anything yet?

It would have to be an extremely fast approval of the K1 for her to be here by the time she gives birth. K1 is averaging 6 months.

Check with your employer if you can add her to your health insurance. Note: Most organizations have open enrollment going on right now (Oct/Nov), so you need to move on this quickly. If your employer won't add her to your insurance, then EM_Vandaveer's advice is probably your best bet. The $20k cost sounds right to me. A USC friend with illegal wife just spent that exact amount for a recent birth. Good luck!

EDIT: Oh, and note, you'll have to do some airline shopping if she's going to travel in the 9th month of her pregnancy. From previous VJ threads, some airlines are really restrictive and others are a little more lax.

Most airlines won't let a 9-months pregnant woman fly, anyway. Especially on a transatlantic flight. Edited by EM_Vandaveer

We've filed nothing so far. As far as having the kid there, I think we'll have to at this point, but should we get married now and file K-3? Would it be better to have it out of wedlock and go for the K-1? My understanding is the child will be a citizen as long as we go to the consulate and do all the paperwork there.

Slim chance of her being able to give birth here in the US given your timeline.

Marry and file for a CR-1 or file for a K-1 so you can marry in the US. A normal pregnancy isn't a valid reason for an expedite, so that wouldn't be an option if you were considering trying.

K-3s are tantamount to obsolete.

I'm the USC and pregnant. I stayed in my husband county after we married and was able to dcf and within 2 months he had his visa approved. I thought about leaving after we married but it wasn't fair to him or our child to be away for about a year and once I found out about dcf I stayed. Delta is the best airline to buy tickets while pregnant they allow you to fly during your last month with no doctor clearance medically. We are due in December and just waiting for his visa and passport now so we can purchase the tickets home.

Also I seen a post about a guy doing k1 for his fiancé and she is pregnant and can not complete the medical that's required until after she has the baby do definitely check into that also. I forgot what country she is from

I was able to expedite my husband application because of my pregnancy. I came as a tourist and have no residency at all. Aboard meaning not in USA

Yeah, I now remember Delta being the exception on flying in the 9th month.

Also, one of the posters mentioned that it's very unlikely that a company would insure your pregnant girlfriend. You won't know for sure unless you check. You might be able to get her on your insurance after you bring her here and marry her immediately, because then you'd have a life changing event and wouldn't need to wait until the next enrollment period. You're dealing with a very narrow margin of error here. You need to be sending stuff to the USCIS in the next several days to make it.
