No, OP received information that her case was returned. You don't know that her case is at the embassy.

Why would you say that to her and give her false hope.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Just some insight on what happened to my husbands petition in Morocco. His interview was 10/20/14. After the interview was over the CO told him they would see him again and they would call him with the information. After 30 days i started emailing the embassy. Each time I would get the same response that they were reviewing it and would let us know when it was finished. The CEAC website always said administrative process. In Feb 2015 I started contacting the Senators office. They emailed the embassy to find out what the problem was. They heard nothing. I called them again 30 days later since I hadn't heard anything. The senators office emailed them again. This time we got a response saying that our file was returned with 221 g and gave the pouch # This was 3/15/15. We waited again. Several months go by I call the senators office again to have them check on our file. The file actually goes back to NVC first. Our file was there. They kept it for a long while before sending in to USCIS. They received our file on 7/12/15. They did contact me letting me know it was there. After 3 more months of hearing nothing the senators office contacted them again. They said it would take 1 year before it was considered out of regular processing time. I did contact them at 6 months 9 months 10 months 11 months 12 month. After 12 months and still nothing I made an info pass with the local office and called the senators office again. At the info pass they said I should have received an email from USCIS. They printed me a copy which said that do to a back log in USCIS which had nothing to do with our file it would take another 6 months before they would be able to get to our file. I flipped. Contacted the senators again. He contacted them again twice. The second time he told me if i didn't hear something in a couple weeks to let him know. Finally on 8/29/16 we received our NOIR. We sent our rebuttal back and they received it on 9/18/16. Its now been over 30 days with no response yet. I call USCIS they said to call again once the 60 day mark was finished to check on it again. Hopefully you now have so idea of how long this process takes. Keep collecting evidence now so you don't have to try and collect it all at one time. I hope the best with everyone in this crazy journey. Try not to stress too much it really doesn't help. Keep up with everything it will make the rebuttal easier. Don't be surprised if the reasons are extremely stupid.

Thx dee..update got a email from Turkish embassy saying a document associated with his application was sent to their post office.I emaikd back trying to find out what document.we would spent $600 to fly just to get it. On VJ someone said they'd send documents back to usic.any one can relate?

it is not wrong to say refile

i appealed my NOID and i won it

court said marriage was bona fide and to refile

the appeal process took over a year and the refile took 2 more

please do not tell Morocco citizens what to do

the embassy is not like yours

we won the refile

so, anyone wanting to wait for NOIR or NOID waste time

you can refile and when the information comes as to why denied, you have a year to make it right for the new intreview

if you have not been thru casa embassy, you don't know what we go thru

Everyone understands the difficulties that you and your husband went through.... However, your journey is NOT the norm and that is why people keep telling you to stop advising people to not wait for the NOID/NOIR and to just re-file. You keep giving this advise to everyone (no matter what their country is) and insisting that your difficulties are the end-all-be-all of experiences, when they are not. What the more experienced and longer-time members keep trying to explain, is that If a couple does not know the reason for the denial (which they get with the NOIR/NOID) and they cancel that petition and refile, that they will re-live a denial most of the time. One must overcome the reasons that they are denied. I'm truly sorry that you and your husband had such a difficult time, but, again, that is NOT the norm. Some of the people telling you to stop giving this skewed advice, have been through denials themselves from equally difficult countries, and are speaking from experience, too. And don't start with the "other people don't understand Casa like you do.".... because, again, your experience is NOT the norm. I've been on VJ for a very long time, and I have only seen one or two other cases from Morocco, that had as tough a time as you have... And hundreds that have not.

Thank you very much. Casablanca is very hard embassy it is true. They don't let me to cone inside in embassy, they never picked up the phone , I am spend so much money to call there from USA, they never answered to emails, they never notified beneficiarie that him visa was refused. It is unbelievable! They never called my husband!!! This is big difference between countries, because I never herd what cr-1 was denied and with tons of proofs which my husband has on interview and consul refused to accepted. , she never look to my income tax , pay stubs , nothing, she just told my husband what she has enough of proofs. It is crazy . Any embassy don't doing this . It is abuse of power. And now I have to wait 2 years because someone has bad mood in this day, and refuse my husband visa, after 4,5 year so waiting to be together. I understand what I should to wait for the NOIR/NOID but I am asking people , who has the same experience like me in Casa, because this is the worst embassy which I ever heard. I was waiting 2 hours out side after the interview and crying, but they don't care, they don't wanted even talk to me. Me and my husband the same age, he is even older for 1 year, where and never were married before, any kids any criminal records , so what's wrong , what they want . I am sure that in another embassy our visa will be approved with out any doubts.

Danchykkk.... you said they would not look at the evidence your husband brought... did you front-load the petition? Did he make it clear to the CO that you were waiting outside? Was your husband trying to call them? They only have a small window of time on certain days that they answer the phone. Also, the time to receive the NOIR/NOID is closer to one year (yes, some take longer). Get your congressman involved. DeeCSC had some very good insight. Hang in there. I know that's easier said than done, but it's best to be patient than to make hasty decisions. Best of luck

Yes I was sending a lot of proofs with the petition, and yes my husband told the co that I am waiting to him out side, and my husband called to embassy too, every day and exactly in this one hour that you told me, but even in this one hour (small window when they answers the phone ) nobody answering, only automatic system, pres 1 pres 2 ..... and that's is all, and it is costs 3$ per minute.

For future reference in regards to calling the Consulate... We added an international calling plan to our cell phones for $20 and we get 1000 mins to anywhere. That's much more effective than $3/min. What kind of evidence did you front-load with?

please do not tell Morocco citizens what to do does not matter, this is now a USCIS matter, embassy has refused the visa.

the embassy is not like yours, irrelevant.

we won the refile you don't "win" a refile.

so, anyone wanting to wait for NOIR or NOID waste time wrong advice, you are the one who wasted time (3 yrs).

you can refile and when the information comes as to why denied, you have a year to make it right for the new intreview what are you talking about,

first you say not to wait for the NOID, then you say "when the information comes out as to why denied...." ! That information coming out IS the NOID.

if you have not been thru casa embassy, you don't know what we go thru again, not an embassy issue at this time.

You need to seriously stop giving the same incorrect advice.
