Reapplying for TN Status While Engaged to USC

Hi everyone,

Quick question for reassurance.

For context: I've been on TN Status at the same job in the US since September 2014 -- my status will expire in September 2017, and my job fully intends on renewing my contract for another three years at that point. I got engaged to my USC boyfriend at the beginning of this month -- we first met shortly after I moved here, and we've been a couple since November 2014.

We've begun discussing the wedding, and while it would be possible to have the wedding and begin AOS paperwork before the expiration of my TN Status next year, we both feel that getting married in Summer 2018 would be the best scenario for numerous reasons. This would meant that, ideally, I would reapply for TN Status in Fall 2017, get married in Summer 2018, and apply for AOS to a marriage-based green card directly afterwards.

My question is -- would our engagement possibly jeopardize my TN reapplication, due to perceived immigrant intent? Also, would me reapplying for TN Status while engaged reflect badly once we apply to adjust my status after our marriage, as in, they would see that I renewed my status after my engagement, knowing that I would get married while on the TN Status, even if my job offer/contract renewal is legitimate. Or, does the question of "intent" not cross over -- my intent in renewing the TN Status is to keep my current job, not solely to get married.

Reapplying for TN now has zero impact on your AOS later. Be warned, however, there's a non trivial risk that if you renew your TN at a POE and if, somehow, your engagement is revealed, you could be denied the status and refused entry. A very bad outcome indeed but also one that depends on a number of ifs.

You could reduce or eliminate this risk by having your employer renew by mail without leaving the US. Still, any trip with your fiancé outside the US has the potential of CBP line of questioning forcing you to admit your relationship. As you can imagine, lying at a POE is usually a bad bet.

While you'll likely not have any trouble, two years is a long time to be anxious about travel or risk being denied entry and jeopardizing your job.

Seek the advice of an attorney experienced in TN to AOS cases. They're all over the internet and can be found near cities with major border crossings.

Thanks very much for your response. Good to know that this won't come back in the AOS process.

In terms of applications and crossings, I always have worst-case scenarios in mind, so I have definitely thought about being questioned regarding our engagement. Of course, I could not wear the ring and not reference it, but I'm not comfortable with lying, even just by omission. I'm well aware that the consequences could be much worse that the temporary convenience. We don't travel together to Canada very often (maybe once out of the three or four trips a year I tend to make) but again, it's still a risk not entirely worth taking, especially for someone who already tends to be anxious!

I had considered the option of renewing by mail in the past, the only barrier being the greater cost than doing so at the POE. But I'll definitely keep in under advisement.

Why not do a court wedding and file the AOS paperwork?

You can have a big celebration later, if you want.

Glad to hear you have reasoned through this. Definitely consider the mail renewal for reasons beyond cost. All it takes is a run in with a CBP officer having a bad day at the POE. Renewing by mail is virtually guaranteed (I did it 3 times).

I was also once in your exact same shoes and didn't have the stomach to wait for too long. I renewed the last TN by mail after our engagement then proceeded to getting married (in Court) and filing AOS before I made any trips back home. Then using my AP traveled back and forth a couple of times. The good news is, it took 60 days to get the EAD and AP so I never felt stuck here. And not once was I questioned about having a valid TN and AP at the same time. It seemed obvious to CBP officers what was going on. Then within four months I received a conditional GC so both the AP and the TN were moot. That was years ago and I guess it takes longer now to get the GC but still within a year.

Yes, this was my concern -- that even if the job renewal is valid, the "intent" in being engaged takes precedence. I'm definitely looking to avoid any potential pitfalls and do this the right way. We'd still need to discuss the logistics, but a legal ceremony and getting a jump on the paperwork, while not the most romantic of notions, might avoid huge headaches later on.

I've seen several dates/windows floating around, but it would be good to hear from someone with numerous experiences doing it.

Glad to hear that the mail-in renewal is generally simple. One question I do have about that process -- how soon before the expiration of your TN do you recommend sending in the application? Your employer will have to file for the renewal and pay all the fees. That's a requirement of NAFTA, I believe.

Of the three renewals I had, two were expedited (an extra $1,500 back then) and one was regular and all were sent at least 90 days before expiration of current status.

If I recall correctly, I still have that paperwork at home, expedited renewal apps took about four weeks and the regular one took ten weeks. Once approved, your status is updated in the system and on your next return trip, you get a new stamp and expiry date for the new three-year period.

Do what's right for you but remember USCIS has vast powers over people's lives. If at all you can move forward the marriage and file AOS, you can enjoy all the romance you need later. Even if, God forbid, things don't work out with your fiancé or spouse, at least you would not have lost your opportunity to work here too.

Ah yes, thank you for clarifying, and for passing on the specifics -- I completely forgot that the mail-in renewal is via the employer.

The power USCIS wields is really staggering -- I don't think it would really hurt things in the long run to make it legal and be able to know that our future together and my job won't be possibly jeopardized by all these factors. Just wanted to chime in: I was in a very similar situation to yours, and just got approved for a green card this week (you can see my timeline below). I did get my TN renewed after our engagement and before marriage in the US. USCIS at Pearson never asked anything about my person situation, and I didn't volunteer it. I suppose if asked I might have said I wasn't sure where my fiance and I would live in the next few years (we had considered moving to Canada). To be honest, I've worked with many people who have renewed their TNs well-after being married and didn't have a problem. For me, the only thing that was annoying in the whole process was what Mounat said: you can't leave the country while you're waiting for EAD/AP processing. Mine took about 75 days, at which point i travelled. And then it took about 250 days total for the green card approval. Happy to answer any other question you have.

Thanks so much for sharing! This was pretty much exactly how I envisioned it might go before my original post's concerns dawned on me. It's good to know that it worked out for you, and that your colleagues have had similarly positive experiences. I think I imagined if the agent saw the ring, the question would come up, but of course, I could always not wear it. But I don't know if banking on them not asking, and not volunteering the information, is the safest bet? I know how much of a TN application really rides on the particular agent you speak with. My first experience with it was very positive, but it wasn't without its leading and prying questions!

Thanks so much for sharing! This was pretty much exactly how I envisioned it might go before my original post's concerns dawned on me. It's good to know that it worked out for you, and that your colleagues have had similarly positive experiences. I think I imagined if the agent saw the ring, the question would come up, but of course, I could always not wear it. But I don't know if banking on them not asking, and not volunteering the information, is the safest bet? I know how much of a TN application really rides on the particular agent you speak with. My first experience with it was very positive, but it wasn't without its leading and prying questions!

Speaking of prying, I flew to Detroit last weekend and drove to Windsor. On arriving at the border on the ambassador bridge, I handed the CBSA officer my Canadian passport. He asked my where I lived and I told him Houston, Texas, to which he replied what's your status there. After telling him I'm also a US citizen, he asked how I acquired it. I explained that I married an American and after several years went through naturalization. He got mad a bit and responded that he knows how it works then asked how ended up in the US in the first place. Then I committed the cardinal sin of cracking a joke at the border by saying, it's a long story, you have time? Long story short, he asked to see my US passport and sent me to secondary inspection. I still made it out in under thirty minutes but boy are these people cranky and unpredictable.

Don't stress, your case is quite common for Canadians since NAFTA came along. :)
