Current B1/B2 Visa Holder, Filling for Marriage - Will my B1/B2 of 5 years be revoked due to the marriage filling? [merged threads]

My husband-to-be has a B1/B2 Visa with Multiple Entries for 5 years.

He can stay in the country for 6 month intervals.

We have decided to get married and want to know if he will need to file a K1 or go straight to the "Adjustment of Status"?

Also, If he files for the K1/Adjustment of status will it effect his current visa and if so, how?

If you have a B1/B2 Business Visa with multiple Entries and Exits for 5 years with 6 month intervals. Is it necessary to exit back to your country of origin in order to return to the states or can you visit another country and then re-enter into the country of your visa pass?

Timeline

Any country besides Canada or Mexico counts. The only issue I see is if you don't frequently return to your home country. A CBP officer at the border may question your ties home and you might run into trouble.

Once he files AOS, he'll get a green card. That will automatically invalidate his B visa.

you can't enter that much to the us, you are supposed to live in your country more than here, so if you're never living and working in your country, that is suspicious

if you come too often, they can take your tourist visa away

it is different if you come a couple of times a year, for short periods of time, but if you stay months at a time, they start to think that you live here, because what employer in your country would give you so much vacation?

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Note, your husband to be will not be able to leave the US once the I-485 petition has been filed with USCIS until he receives his EAD/AP combo card which will allow him to both work in the US and travel outside the US if he needs to. Be sure to file forms I-765 & I-131 along with the I-485 to obtain this combo card.
