Green card holder - out of wedlock children

Hi,

At the time I got visa, I had children that I couldn't mention in my application form as I was single. Now that I have been married, can I file cases for sponsor of kids and wife, will embassy or USCIS object on why I didn't mention them in my Ds260. Whats my best option, if anyone has gone through this, please guide.

I got married this month! I didn't lie, I didn't know that out of wedlock children had to be mentioned, I was of understanding due to the social system over there that only within wedlock children had to be mentioned on the form.

Pakistani society does not approve live togethers and children out of wedlock. Its crime under Islamic law in Pakistan. US embassy in Pakistan must have this knowledge. If you sponsor children now, your immigrant visa might be reviewed and at risk of revocation. However consult an attorney who is well versed with Pakistani culture and laws.

But on the application it clearly asks if you have children. No matter what the circumstances, with the intended spouse or past relationships.

I don't understand why you wouldn't mention your children to begin with, I think you will encounter some hefty questions when you look into move forward to sponsor your children.

My guess is that the Consulate will be looking for an earlier marriage, or evidence of marital status.

There was no reason for you not to mention your children, you were dealing with the US Government, not the Government of Pakistan.

It definitely will be scrutinized, I'm not sure if you'll be hit with a misrepresentation, I'm assuming you won't be because you would have gotten the visa even if you put your children on the form like you should have.

I agree with the above poster, they'll probably look closely to see if you were married BEFORE your visa was issued or BEFORE POE, precisely because Pakistani customs and laws (living together & having children out of wedlock is rare there).

Not good

it clearly says all children are to be listed

lying to immigration doesn't help your situation

it may look like you are trying to bring in other family members

and saying you broke the law in your country and immigration laws

not trying to be rough but i doubt you will get very far

DNA tests may help

You are out of luck.

You cannot lie twice on the application. And, USA doesn't care about your culture or laws.

According to your post, OP is criminal in both Pakistan (under local law) and in USA (for false representation).

USA doesn't care for your laws. I believe, OP's current GC should be scrutinized for false representation.
