Expected Waiting Time for Work Papers

Timeline

Hi VisaJourney Community,

I am writing to ask about how long my fiance realistically can expect to wait before he is allowed to legally work in the U.S. We plan to be married in February or March of 2017 on a K-1 visa. I realize that the time has to do with how long it takes us to fill out the paper work and submit it, but I've heard that it can take anywhere from 5 months to up to 4 years and I just want to know what we should expect. Any information (links, advice, personal experiences) you could provide would be helpful.

Once you're married and have filed the AoS paperwork with EAD, it usually takes about 3 months. 3 - 5 months is a safe range to expect.

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

AFTER your fiancee enters USA on his K1 visa you have to apply for EAD and AP (Include it in your AoS package). It takes about 60-90 days from submitting AoS to receive the work permit.

Don't plan or book anything before he gets his visa. You might or might not get it before February/March 2017.

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.
