Hi I am helping someone out but I am lost as well.

In short he was refused h1b visa under other section 6ci

What 6CI. And will that effect his i130. Immigration process and if yes then what he needs to do?

Check Guides From Guide section for doccuments and list of stuff and follow this steps


Step 1 After USCIS NOA2 Gather all AOS / IV Package Documents In 3 weeks


Between USCIS Approving and NVC Case Number you have 2 to 3 weeks gather all AOS and IV Documents Get package ready.


Step 2 Obtain NVC Invoice and Case number.


​After 2 weeks of NOA2 Keep on Calling NVC every day to get case number And Invoice number


Step 3 Pay First Fee and DS261


After getting NVC Case Number and Invoice Number Log in to webpage Pay First Fee and Fill out DS261 Takes 24 to 38 Hr to get fee status paid.


Step 4 Conform Agent / Ds261 Over Phone and Sent out Documents


Once First fee turns Paid Online ( Usualy 24 to 48 hr) Call NVC And conform choice of agent over Phone If they won't keep on calling them Until someone will Or other fee won't be unlocked.Also Once you get Welcome letter on email Print out Document Checklist sheet And Sent in your documents to NVC


Step 5 Pay Other Fee and Fill out DS260 (Total time from DS 261 to here should be no longer then 15 days )


​Step 6 Conform Document delivery AT NVC And Ask them Processing Time..


Step 7 Check For CC ( Hopefully no REF )


Call them every other day 2 weeks from DS260 and Check status.. Also Check Online NVC Page If you have 3 N/A your case Complete! Congratulation you are almost done.


Step 8 48 Hr After CC Conformation Call NVC For appointment for interview


Congratulation On your NVC CC AND Good Luck with Interview

Fraud or misrepresentation will indeed make his journey harder.

He'll need a waiver for that.

Depends on what the story is.

Sorry for delayed replay

Story is he was on Student Visa and jumped school. And one of school he left was closed down due to fraud but he left 6 months from that school and he was not aware of that.

And after study he converted to H1B ( he ihas done D Pharm)

And worked with same employee for 4 yr before returning to India for visit to family.

He went to Embassy at Mumbai for stamping ( with valid current Approved H1B and was refused under 221G and asked for Doccunents and embassy emailed him again for Intervew and he was handed 6ci without asking any questions.

Meanwhile when he return to India he got married to USC ( that part was unexpected also because he was attending her sisters wedding ) and i130 was approved just few days ago.

Now will that 6Ci from H1B will effect him on i130 CR1 ? If yes then what's steps to make his i130 CR 1 Intervew go smoothly.

I do t know school name but I will ask him about it. All I know is it was located in Jersey City NJ

Already got lawyer and State Sanator office involved on his case let see what happens. Lawyer is filing 601 and state senator is finding out reason of denial

Nah he is from Guj. Married to USC was like totally random. He did not even know she was from US until they got close to engage.

How would one not even know where a person is from until almost

engagement? hope they dont tell that to uscis LOL that'll definately

be denied. The first things couples discuss after meeting is origins,

family, age, schools, adventures etc.

This is just chasing a GC and of course if he dont tie himself up further

he may succeed. Get a lawyer
