Hi,

My husband and I have been filling out the adjustment of status paperwork, and we're not sure whether the tax documents we have are what is needed for the I-864.

He runs his own business. There's no employees or other owners, just him. He has a Form 1040, including schedule C, showing his income and business details for 2015. No W-2 or 1099. Is this a tax transcript? Will it be enough for the I-864?

Sounds it's his tax return, not the transcript. He can go to this link and get his https://www.irs.gov/individuals/get-transcript

He's ordered a transcript but it looks like it will take a while to arrive, sadly.

I know the I-864 instructions say we can use a tax return instead of a transcript - do you know if just the 1040 would be accepted? From my very limited googling it sounds like he shouldn't have any W-2s or 1099 given his current work situation, and that the 1040 and schedule C might be his entire tax return.

It would have to be all papers from the return. I have little to no knowledge on USA taxes, so Im sorry I can't help much. The tax transcripts took less than a week to arrive last time my husband got them, so if you could wait, that would be best to go with the i864

Form 1040 is the main tax form. Then each filer can have any number of schedules or other forms depending on their situation. Schedule C is profit and loss from a business so yes that's part of the tax return. He probably also has schedule SE which is self-employment tax and basically covers his contributions to Social Security since he doesn't have an employer holding out Social security and Medicare. If he earns any interest from a bank account for example, he would have a schedule B. All of that makes up his complete tax return. You are correct he would not have a W-2 because he doesn't have an employer and the only reason he would have a 1099 is if he is a self-employed contractor.

They are really tough on just 1040 copies and often RFE for the official tax transcripts for self employed.

Transcripts usually arrive in 7-10 days.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
