F2A priority date problem. PLEASE HELP!!!

Hello everyone. I am really desperate and confused about my situation, I hope someone can help me and advise for my situation.

My husband is Green Card holder and I work in USA with H1B visa. Our I-130 has approved and my PD is 10-05-2015. My attorney advised me to check Visa Bulletin B. DATES FOR FILING FAMILY-SPONSORED and when my priority date is apperead we would be able to apply for Adjustment of the Status. My priority date became available on June,2016 and we sent our forms but it was rejected due to "your priority date does not appear current". but Visa bulletin shows 10-15-2016 for June. My attorney says Immigration office and State department is not working in in sync even though Visa Bulletin shows my priority date is current immigration office cannot handle that much applications and do not accept any more applicants and we have to wait until Fiscal year which is October to get any update... I checked with another lawyer and he says My current attorney looking at the wrong visa bulletin, we spouse to look at A. APPLICATION FINAL ACTION DATES FOR FAMILY-SPONSORED PREFERENCE CASES as I am currently in USA which is 15NOV14... I cant really afford to wait 1 more year as my H1B is expiring on March 2017... Can someone please help what is going on and is there any action I take from this point except waiting for a year...

Your first attorney was wrong to advise you that way. USCIS might use Table A or Table B to allow applicants filing i485. Earlier this year, USCIS was using Table B but these months USCIS is using Table A. Nobody know which table USCIS uses for a given month but it's safe to assume that it will keep using Table A for at least next few months.

Each month you have to look into https://www.uscis.gov/visabulletininfo to find out which table it is using for i485 applicants and whether you can file i485 in that month. If you cannot file i485 by march 2017, then either you have to find a way to stay in US in other legal status or leave US and opt for Consular Processing.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Hi Mineta,

Please check the second paragraph of the Visa Bulletin. It clearly states that you need to check the USCIS website www.uscis.gov/visabulletininfo to see whether the USCIS is accepting the "Date of filing" or "Final Action dates". For Family based categories, USCIS was accepting Dates of Filing until April 2016. Thereafter USCIS stopped accepting Dates of filing and advised to go with the Final Accepting dates. I personally got burned by the Lawyers that know nothing and giving wrong information. Hopefully USCIS will start accepting Dates of filing during FY2017 which starts in October 2016. Check the USCIS website about 10 days after Visa bulletin gets published.

Dear Shone,

Do you know when they start using "Dates of Filing" chart, will they most likely be using the same date where they left off which is 22NOV15 for August or they will start a new charts with new dates for "Dates of Filing"...

It is hard to tell. Most likely they wouldn't retrogress to an earlier date. They won't be using new charts or new dates each year. It will be a continuation of the previous year. You can check AILA (American Immigration Lawyers Assoc.) News for latest updates.

Agree. I used to do some math based on Demand Data as a side hobby that they used to publish to predict visa bulletin movement in Family based category. But it did not add up for me just based on that. I guess they have other numbers that they don't publish to come up with VB.

One thing that always baffled me was how could they "spillover" visas from FB to EB when based on Demand Data and VB FB was retrogressed. :-)
