Hello guys,

I'm new to this forum and I've find it very helpful to read all the experiences with filing for K3 visa. Right now I have a question to where to file for the K3 visa? Where would it take shorter time to process our application? if filing through the US Embassy abroad or filing from the USA in the state of Texas?

Thank you so much in advance for your help.

J.

Welcome to the forum!

The K-3 visa is essentially dead; the CR-1 visa is what's issued (and is superior to the K-3).

If the U.S. consulate in your foreign country of residence allows Direct Consular Filing (DCF), it should be quicker.

Your thread is moved from the K-3 Process forum to the CR-1 Process forum, for now. If you return to report that you're pursuing DCF, your thread can then be moved to that forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

In order to file through a USCIS field office overseas, you would need to be a resident of that country for at least six months prior to filing. In your previous post you mentioned your wife is in Ukraine. I'm not sure if you live there too but even if you do, Ukraine does not have an international field office of the USCIS so does not offer consular filing.

It looks like in your situation you will be sending to the Phoenix lock box for processing at a USCIS service centre in the USA. As mentioned before, the K-3 is as good as obsolete so prepare for about a year of processing for a CR-1 visa.

It's tough. All of us are in the same situation and desperate to be with our spouses as quickly as possible. You will need patience by the bucket load. It won't be easy. It won't be quick. No one can say exactly how long it will take. But we all know it will be worth it.

Thank you guys for the info and advice is greatly appreciate it, I will be filing for the CR1 from the US. Now I only have couple of questions,

1. About the affidavit sworn for the bonafide marriage, do we need from people who knows my Spouse or Do I need from my side as well?

2. What is the fee I have to write the check for filing for the CR1 ( I-130)

Thank you so much for helping us in this long process.

1. You don't need them from anyone. They are low value forms of evidence. Focus on evidence of time spent together (passport stamps, tickets, hotel receipts, etc) and some photos of the two of you together and with family members from both sides.

2. $420

The denial of a tourist visa won't interfere. Chances of a tourist visa being granted while being married to a USC is extremely slim.
