I'm currently a student. I have been married to my husband for approximately 7 months now and I'm looking to file an AOS. We currently live with my aunt in her two bedroom rented condo in texas and we aren't on the lease. We pay her a set amount monthly for the rent and all the bills. Also, I currently go to graduate school in the east coast so we only live together during holidays and when I am back in town. We are currently both 23 and trying to find our feet so we can't afford our own place although my husband works. Is the fact that I go to school in another state an issue? Also, is the fact that we are not on the lease an issue? My aunt has agreed to write up an agreement for us stating we live there and pay her an agreed amount monthly.

The agreement your aunt is willing to write up is a start, but you're probably going to face much bigger challenges in getting AOS approved. One thing that stands out is that you're not really living together. Cohabitation is probably the #1 factor they consider in determining whether you have a bonafide marriage.
