applying for k-1 visa, no income and receiving food stamps and cash aid

hello po im page from cali.. ask ko lng po if may chance po kaya if ever ill apply fiance visa sa daddy ng baby ko.. hirap po kasi situation nmin mg 7 mos na c baby d p po nkkta ng daddy nia.. last yr aug 2015 ako umuwi dto cali kc tinapos ko muna po nursing ko and ng exam po ako local boards after that i got pregnant.. dto npo ako ngdeliver.. wla po ako work but my stepmom is willing to cosponsor and another concern me and my baby were receiving foodstamps and cash aid.. d po ako mkawork kc wla po mgbabantay k baby .. kya gsto ko ipetition fiance ko pra mkpagwork ndn po ska sya po magbantay temporarily k baby... please help me.. thank u po

hello im page from california.. i have been here in US since last aug 2015.. i want to ask about filing a petition for my fiance from the philippines.. i dont have work .. im concerned bec i dont have any income.. and another, me and my baby were receiving cash aids and food stamps.. my baby is turning 7 mos this aug 08. its very difficult for me and also for my fiance that were apart from each other.. were in a relationship for about 9 years already.. i just finished my nursing in the philippines and took the local boards.. then i became pregnant so i flew back here to give birth.. please help me regarding this matter .. i really want my fiance to be here with us .. thank u so much who will reply to my post God bless

What is your immigration status?

That would change the answer.

If you're a US Citizen then you can petition your fiance.

If you're an LPR, you can petition but you have to be married.

As for the finances, you will need a co-sponsor that meets the poverty level requirements.

thank u so much for replying.. im a us citizen already.. can i still receive assistance when i already started applying? or i must give up the assistance regarding the petition?? hopefully my father will co-sponsor also with my stepmom.. im worried about my situation now i dont know what to do

Here are the guidelines:

Sponsor's Dependents 100% of Poverty Guidelines (Fiancé Visa) 125% of Poverty Guidelines (Green Card)

2 $16,020 $20,025

3 $20,160 $25,200

4 $24,300 $30,375

5 $28,440 $35,550

If you cannot prove this level of income you will need a co-sponsor. First line applies to you (fiancé and baby)

thank u very much for that.. im a US citizen.. i cant work bec no one will able to care for my baby.. i want to file a petition so that my fiance will take care when im working.. our foodstamps and cash aids are a big help for my baby .. i hope that the immigration will us a chance regding our situation

It's no problem for the US citizen to be receiving aid - to be honest there is no place on any financial form that asks if any US citizen is receiving federal or state aid, so it's not even going to come up.

What they are concerned about is that the immigrant be supported and not become a public charge. Normally, you can have a joint sponsor to meet those support requirements for either K-1 or CR-1. However, I understand the embassy in Manila does not accept joint sponsors for K-1 (though it also seems they don't ask for financial info?). I'm no expert on the Philippines so I'll let someone else elaborate on that, and figure out whether the K-1 is an option for you or not.

Joint sponsors are excepted but limited approval at USEM. Financials may be asked for but most times not. The difficulty is when she files for AOS she'll be required to meet 125%. She would be best off to marry in the Phil and File a CR1.

Even then she will have to complete an I-864 Affidavit of Support for the NVC and still meet the support income requirements.

I thought that after I posted. Thanks for the clarification.

If she gets a Co sponsor then USEM has to take them on a CR1 but not on a K1. So I still feel CR1 is best.
