Cancelling Affidavit of Support I-864 questons.

In mid June I completed, and submitted, an I-864 form for Joint Sponsorship for a Sister in Law I have never met. My Mother in Law is the other Joint sponsor but her income is too low so she needed my help. I did it as a favor to her (my Mother in Law) and my wife would not have been upset if I had decided not to.

Now it's the end of July and I'm having second thoughts for a variety of reasons. I have several questions...

What is my window to send a letter of cancellation? Do I need to cancel immediately?
Will there be an opportunity for someone else to be a joint sponsor? I don't want to ruin her chances since she's been waiting a long time for this opportunity but I also don't want to be financially responsible for her.

And is there somewhere I can see a clear timeline of how this process works? I have been searching this forum, and googling, but have not been able to get a clear picture.

I know you are having second thoughts, but are you aware of what your financial responsibilities actually are ?

"The Form I-864 Affidavit of Support is a legally enforceable contract, meaning that either the government or the sponsored immigrant can take the sponsor to court if the sponsor fails to provide adequate support to the immigrant. In fact, the law places more obligations on the sponsor than on the immigrant -- the immigrant could decide to quit a job and sue the sponsor for support.

When the government sues the sponsor, it can collect enough money to reimburse any public agencies that have given public benefits to the immigrant. When the immigrant sues, he or she can collect enough money to bring his or her income up to 125% of the amount listed in the U.S. government’s Poverty Guidelines (as shown in the chart in Form I-864P).

The sponsor’s responsibility lasts until the immigrant becomes a U.S. citizen, has earned 40 work quarters credited toward Social Security (a work quarter is about three months, so this means about ten years of work), dies, or permanently leaves the United States. If the immigrant has already been living in the U.S. and earned work credits before applying for the green card, those count toward the 40."

If you want, you can withdraw as long as the person hasn't been granted immigrant visa/status yet. You can send your written withdrawal notice to where that case is being processed at (USCIS if AOS or NVC/embassy if consular processing). She then be asked to get a new joint sponsor and any other people can be a joint sponsor.

If you want, you can withdraw as long as the person hasn't been granted immigrant visa/status yet. You can send your written withdrawal notice to where that case is being processed at (USCIS if AOS or NVC/embassy if consular processing). She then be asked to get a new joint sponsor and any other people can be a joint sponsor.

How long does it take to be granted immigrant "visa/status?" As I mentioned I sent in the form a little over a month ago and I'm worried I need to make a decision immediately (or am already too late.)

It depends on what category was the petition filed and whether she is going through AOS or consular processing. If you've sent i864 just over a month ago, she is nowhere close to getting the immigrant visa/GC yet. It'll take a while.

It depends on what category was the petition filed and whether she is going through AOS or consular processing. If you've sent i864 just over a month ago, she is nowhere close to getting the immigrant visa/GC yet. It'll take a while.

So what is the best way to cancel my I-864?
