My wife is a US citizen and we live overseas, she wants to return to the US, and is considering filing for my permanent residency, however she doesn't have a job in the US yet, and cannot meet the income requirements once there. I'm a self-employed consultant using a US freelance platform and I've made several times the poverty guidelines over the last two years. Even though I'm not in the US, and it's not regular income every month, I expect this income to continue after we relocate to the US.

1. Can my income be used to meet the income requirement on the affidavit of support?

2. If so, what should I submit as "proof this income will continue from the same source" when we relocate to the US?

Yes. There is a space on the form for the intending immigrants income and assets.

For proof- Well you are self employed. Im assuming you keep 'books'. I mean you have to have spreadsheets tracking your income. If you do not then simply make them now. Its a little different with self employment income. You will need to show you have been self employed for a min of 1 year. This is established by having a tax return. In the US taxpayer system there is a special form (schedule c) that self employed people use. Do you have something similar there? Do your taxes state anything useful? Start with that and build off it. If your taxes for 2015 show 114k in earnings then your spreadsheets should show amounts totalling to 114k. (Im not sure what your wifes US tax returns show but they also have to be included so maybe theres something there)

You also should send an 'employment letter'. This is a simple straightforward letter addressed to whomever is reviewing it explaining what you do, how you are paid, how long youve been doing it, education, training etc. This is where you really want to sell yourself pushing the point the income will continue and is stable. If you have pending contracts in the future or active accounts submit proof of that.

everyones situation is going to be different so its impossible to give you a checklist of what you should send. Some people need banking records because of how they are paid. Some people need proof of contracts. It really depends on what you say you do and what you can come up with to prove it. Anything you say try to find proof of. Just remember the more documentation you have the better. Ive known people that even included a copy of their business card lol.

Yes it can be used, as it will continue from the same source once you immigrate. The issue I could see if it is very variable, they may not like that... but if it is consistently above the poverry line, you should be fine.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you both for your responses!....I appreciate the detail.

I have local (foreign) tax filings, so I'll use those; and I think the employment letter and banks accounts are a good idea. I might even print a client and earnings history from the US online freelance platform that I use.

We're now on to trying to fill out the G325a; and my wife is wondering about the 5 year address history. She's wondering if she should include her parent's US address somewhere in the list.

She didn't live there, but she used it for domicile purposes, and bank accounts, credit cards, driver's license, to file taxes, voter registration etc then followed by our foreign addresses where she lived with me....or the addresses (in another city and state) where she lived and worked before moving overseas with me, followed by our foreign addresses here.

She's worried that it might look strange to the immigration officer if she used her parent's address and claimed residency for all the purposes above, but it doesn't show up anywhere on the form.
