I-864: Current individual annual income

Hello,

I am filing an AOS from K-1 and my wife and I are working on form I-864.

I have a question after reading the following online:

The I-864 in Part 6, line 5, asks the sponsor to indicate his or her “current individual annual income.” This phrase is key and every word is significant. “Current” means what he or she anticipates earning this calendar year. That may be easy to calculate in December, but more difficult early in the year. So be prepared to ask your client for proof of what he or she is currently earning and likely to have earned by the end of the year.

My wife has started to work on June and let's say, for example, that she is making an annual salary of $50,000.

Are we suppose to write on Part 6.2 under "Current individual annual income" that she earns an individual annual income of $50,000? Or are we suppose to write the prorated amount until the end of the year from June (7 months), therefore: 7 * (50000/12) = $29,166 ?

Yes. She has that job currently (right now). Therefore, that $50000 is her current income.

It's the same thing the link said. Projected income for the entirety of the year.

EDIT: sorry, I misread your first post. If she started to work in June and did not work January-May, then for current income you put ($50k/12 ) x 7=$ 29,167

You do NOT prorate the income. It is current ANNUAL income, not what you have made so far this year, and not what you make in only a calendar year of Jan, - Dec. Annual income is not confined to any specific year. So yes, that information from that website is incorrect.

For example, someone that gets paid hourly would take their hourly rate and multiply that by hours worked per week, then they multiply the weekly amount by 52 weeks in order to get their current annual income. That is the amount you would enter on the form and you use a letter from employer and/or recent pay stubs to prove that is in fact your current annual income.

If she makes $50k annually, then that is what she puts for her current annual income. Provide documentation that she earns that.
