Traveling to foreign country while IR 1/ CR1 is approved

Hello all. My wife is US citizen and i am living in India. We have filed for IR 1/ CR1 immigration visa in march 2016. We received NOA1 till now and awaiting NOA2 and approvel of our case soon.

We would like to know is it good option to travel for her to India once the case is approved.

Does she require to be present in the states until all processes are complete. Will her traveling affect the visa process in any matters. Or in the sponser stage in later process.

Please let me know about good advices whether she can travel to India and stay here until my file is being processed.

The USC citizen travelling during the visa process is absolutely fine, and in fact, you two spending more time together wil make approval more likely.

The problem is, unless she can take time off work and keep her job, how will she financilly sponsor you?

The USC citizen travelling during the visa process is absolutely fine, and in fact, you two spending more time together wil make approval more likely.

The problem is, unless she can take time off work and keep her job, how will she financilly sponsor you?

Hey. Thanks for the reply. As for the financial sponsership can their parents be the co sponser as she is just doing a minimal job as of now.

Hey. I also wanted to know as my wife was planning to travel to India once the case got approved. So is it a good idea to travel straight after the case is approved or do we need to wait for all AOS and IV procedures done as she might be required to present her income in sponsership. Even if she travels can her parents only sponser using their financial support.

What is the best idea should she travel directly or after the financial sponsership docs are done and submitted ? Please give me advice which can be helpful to take a decision.

If she has a well qualified co=sponsor in her parents, it doesn't matter when she travels.

If she needs to sponsor you herself,m she must stay home, as the income must be current and ongoing.

Thanks. As per the requirement of 125% of poverty line income and the her parents with household of 5 people do meet the required income. So i think it is good to go for her not to be in the sponser list.

Just to be clear, your wife as the petitioner is ALWAYS the primary sponsor; she will need to fill in a I-864 even if she has zero income as she lives with you abroad.

Yeah i understand that she will have to file an I-864 even with a zero income and separate I-864 for the co-sponsers with their income and returns from last three years. Am i right ?

That is totally up to her. As long as you have a well qualified co-sponsor, she can stay will you have your visa.
