Indian Boyfriend living in Australia wants to visit me in the US on a Tourist Visa

Hi everyone.

I just created my account here just a few minutes back, and I came to ask a few questions. Firstly, let me explain.

My boyfriend is an Indian citizen, but has been studying on a student visa in Australia for almost a year now. I plan to visit him in Australia next year, and hopefully soon after he can visit me in the US.

I've heard from numerous individuals that many Indian citizens are denied a tourist visa for the states because they come here and stay illegally.

My boyfriend has absolutely no intent to do this. He just wants to visit me for a few weeks in the states and meet my family. He's very well settled in Australia. He works and is going to college. He's has no plans to ever leave Australia unless for visiting his family in India or I in the US.

I'm really worried that he'll be denied solely because he's an Indian citizen, and he's in the age group that is high risk of being denied.

So, my questions are:

What do you think the likelyhood of him being denied a US tourist visa is?

If he shows proof that he lives in Australia and is studying there, would this increase his chances of being granted a US tourist visa?

No one here can answer your questions for sure. Whether or not he's given the visa is at the sole discretion of the interviewer.

Basically, all applicants start from a place of having assumed immigration intent. It's then up to the applicant to overcome this assumption by demonstrating that their reasons for returning outweigh their reasons for not returning. Proof of financial ties and obligations to their country of residence is the best way to do that. Owning property, being employed, going to school, etc. are all good, so bringing proof of those things will help his chances.

He does not seem to have strong ties to Australia, and thus approval seems unlikely. With that said, no one can say for sure he will be approved or he will be denied. He should definitely be prepared with information that he is studying, but keep in mind people leave their studies all the time. The only thing he can do is apply and see what happens. A denial would not have a negative impact on a future petition.

That, unfortunately is true. I've read a few instances on other forums of Indian students in Australia with American girlfriends whom they met online and hope to secure a US visa to visit. In some.. not all.. instances, such students had been unable to procure a US study visa, and thus 'settle' for an Aust\NZ study visa but continue to try to travel to the US.

That being said, if you've physically met and are in a genuine bf\gf relationship, he can try for a visit visa. He shows proof of his ties to India\Aust. The Embassy officer makes the decision on the visa based on the interview.

Big, big red flag. This would be my concern as a consular officer. The guy is an Indian citizen, lives in Australia on a temporary student visa but doesn't ever want to leave Australia.

Why red flag?

Because this means he has no right to residence in Australia beyond his studies, but suggests he doesn't want to go back to India ever. As a consular officer, I'd be concerned he's really just shopping for western countries to remain in. I'm not accusing him, just playing devil's advocate.

your info on nationals of high fraud country is good and correct. there is always a 50 % chance of getting a B2. like someone mentioned there can't be definitive answers for your question. Also, i am aware of numerous bogus indian students going to Oz on short term courses with an intent to work more than the allowed number of work hours. the local US mission over there will be well aware of that.my suggestion/ opinion -

Like mentioned before - Getting a B2 for national of high fraud country is a pure fluke., his strong ties to australia will be judged on - kind of course he is pursuing, time remaining on the course, money invested in the course and of course for how long can he stay in australia for. Last but not the least, i beg to differ when you stated that he is well settled in australia. no international student can be while they are studying and doing jobs. i am personally a canadian expat born in a high fraud country and have seen this closely. i hope it will work out for you two. good luck.
