Marriage in the USA (not with K-1). Looking for other similar couples. Not sure where to post this question.

Most people I see who have gone through AOS process (I-130/I-485) have done it through K-1 or IR-1/CR-1. My situation was, we met, and on one of my stays in the USA we decided to get married and filed immediately after marriage. I was within my legal stay (Canadian on a B-2). I'm just wondering if a case like mine presents any issues since I see most people don't do it this way. Obviously, we didn't plan it - it just happened.

Anyone else out there who did it the same way willing to share their experience and maybe give me a little encouragement that what we've done isn't crazy haha :) (We did talk to an attorney - but it's nice to hear from real couples).

We got married in the US while I was on B1B2 visa. That happened on my second visit to the States and after around 4 months of my stay there. Now we both are in my home country planning on applying for my Green Card : ) I wish you best of luck in your process, I'm sure you will be just fine (F)

I got married on F-1 (student) visa, became out of status due to some problems and now am adjusting my status. As far as I know this is allowed and not a problem, unless you got into US with the intent to adjust status and bypass immigration laws. When did you arrive in the states and what did you say your reason for the visit was? Also, when did you get married and when did you file/planning to file for AOS?

I entered as a tourist - that was true, and there was no intent prior to arriving as a tourist to get married - it just developed. We were married in May, and filed last week.

Did you mention that you had a boyfriend/were visiting someone? And when did you enter. There's a 30/60 rule where if you apply for adjustment of status within 30 days of entering the states, then fraud will most likely be suspected. And if it was within 60 days they will be more cautious to make sure that you didn't lie at the border. Of course, it's not a guarantee and you should always say the truth, but it could hurt your case if you got married and filed for adjustment very soon after entering the country.

Good luck to you!

In that case I don't think you should have problems :) I sent my application in on May 17, so you and I should be close to each other in the application process. :)

This is not true. Please don't spread this rumor.

I'm sorry I didn't know this was a rumor, as I've read about it on many immigration websites. I also see it mentioned in a document by USCIS.

https://www.uscis.gov/sites/default/files/err/H2%20-%20Waiver%20of%20Inadmissibility%20-%20Criminal%20-%20212%20(h)/Decisions_Issued_in_2007/Oct312007_02H2212.pdf

Do you have more information about it? I'd like to know more about it, as it might apply to me.

The law is pretty clear...as long as you entered the US legally, you should be fine. It was up to CBP to decide whether or not you had immigrant intent when you crossed the border. Since they let you enter, they obviously felt you had none at the time. Not much to worry about.

I came to the US in August 2015 and we got married in October 2015. I never left since then. We applied for AOS and after 4 months 1/2 I received my Green Card. Stressing procedure as I didn't know what could possibly happen but as long as you enter legally, your relationship is true, you supply all the documents required, you don't have any red flags, you have finances to do it, and you do what is asked, you should be fine.

I'm now a permanent resident, I can see my husband every day (L) I work full time, and I help my community whenever I have free time. I would have never thought of this a year ago :D

Good luck!
