Can we believe the officer? What are they really AP us for?

We just went through an interview in Moscow for CR1. We did DCF, so everything is done in the consulate. I have mixed feelings about thre real reason for AP, read below why.

In 2012 my husband (then only boyfriend) applied for a tourist visa with my invitation and got denied (no travel history). Then he got denied a B1 for a workshop that same year. We traveled, and in 2014 he applied again. He didn't mention me on the application and his reason to travel was tourism - he booked a hotel in New York. During the tourist visa interview the officer asked him if he still talks to me, and my husband said no. Visa was granted, he went to visit me using it twice: once before we got engaged and once before we got married. He did go to New York as he said he would and he never overstayed.

Facts:

we were only dating at the time of B2 application

we had no intentions of getting married at that time

he did not intend to immigrate at that time

he did not overstay, ever

he used his B2 as he said he would - to go to New York.

Now during CR1 interview the officer mentioned it and said literally this: "Now, and this happens, people do this pretty often... In 2014 you applied for a tourist visa and you said you don't talk to her anymore. Clearly, it was a lie, because according to you and your evidence you were dating at that point. It's ok, it happens, and you didn't overstay, we'll go ahead and approve your visa, but to be clear: you lied under an oath. It helps me to put together your story though, it makes sense... Don't worry, we'll get your visa approved, but to make it clear. this is what happened. Did you actually go to New York?"

We were terrified at that point, staring at him. My husband said something like "I don't remember that question", but the officer said it's written right there in his file. Then we said yes, he did go to New York and to Washington and we have proofs, but the officer didn't ask for it.

The officer moved on to other questions and when he got to his work it's like his ears perked up. My husband is DVM, teaches at the veterinary school in Russia. He has PhD in veterinary parasitology. CO asked many related questions from the list, looking for potential work-related red flags I guess (do you have experience in biochemistry? do you work with communicable disease? When was the last research on lab animals you did?" Then asked for his CV and was very happy we had it in English. Husband's list of publications was in Russian though. CO said it's a standard procedure, he will have to go through an administrative processing, which for DCF usually takes 2-3 weeks, especially for family reunion cases, unlike for tourist visas where it's based on demand. Then CO turned to me and said "you know what it is, just like in your case earlier". And yes, indeed I had an AP for a B1 and F1 at the same embassy 9 and 7 years ago. I am a physicist, I was going for an internship at the lab where I now work, and my case was stuck until the consulate got a verification from the lab and the school. CO said if we want to speed it up, we can send an English translation of the list of publications. Then handed a 221(g) with written "Other - translation of list of publications" on it. Overall CO was very pleasant and friendly.

Now I am worried. First of all - bad, bad idea at that B2 interview! But we can't change that now.

What do you think they are really checking - husband's work or his answer on B2 interview?

I mean... he did not overstay, he went to NY as promised, we did all the right things and all our other facts match between all applications and evidence. And CO said we are fine. But can we believe him?

Any experience here on either one of the reasons?

January 2014 US entry, special screening, but admitted instantly once I got to speak to the officer. It's a standard procedure if no valid GC on hand.

July 2015 - MARRIED in Russia

N-400

October 2015 - N-400 sent

February 2016 - interview and test

March 2015: USC!

DCF for my husband

April 2016: InfoPass to file I-130 in Moscow, approved on the same day.

May 2016: DS-260 interview - AP for "dangerous" work field

July 2016: visa issued! 59 days in AP.

May 2018: filed I-751 

June 2018: 18 months extension received

I traveled all over the world in the meantime, no problems with visas and entries, occasionally some explaining and more documents to haul around.

Sounds tome that he let you know that you can not pull the wool over his eyes. Worst case scenario is that he slaps you with a misrep, the way you describe matters that sounds unlikely.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Because of his work, absolutely he would be put in AP. Someone from the UK or Canada would also be put into AP for the same reason. He is a possible threat to US safety and thry need to check him out. Biochemists, pharmacists, physicists, etc... with higher level education are put into AP pending a look at their CV. I believe you dodged a bullet with the lying (lying more didnt help either... really...) but it's the work that he's in AP for.

I believe your in AP for the reasons the CO mentioned, you got to remember, they like to throw their power around at times. They are God in their eyes.

You most likely would of been denied right on the spot, just wait is all you can do, I know its easier said then done.

Well, if that does happen, it doesn't have to be long. I am biochemist/immunologist with advanced degrees who works in Research. I applied through Germany (K1) and was asked exactly one question about my job, did not supply a CV and was under AP for less than 12hours before having my visa issued...

So your husband really never remembered telling the officer at his visa interview that he no longer talked to his American girlfriend who later became his American wife, even when told this was the question and here was the answer? Thhe CO seemed okay with that answer so it is what it is. Thankfully it didnt cause a larger issue right? :)

And AP is a various amount of time... Always has been, always will be.

He didn't remember the question from the interview in 2014 - he applied to so many visas over the years and have been to many interviews... I am not surprised he didn't remember it from 2014, and that's exactly what we told the officer. My husband didn't say it didn't happen, especially since it's written down, but it's not uncommon to not remember every question from every application.

If you ask me what was discussed at all my immigration interviews I will probably only recall a fact here and there from, and I may not be accurate about what was asked when.

Am I missing something ? According to your post he lied and said he no longer talks to you and the CO told him later that was a lie.
It has nothing to do with not remembering anything.
You both were dating and talking, he said no which was not true according to your own words.
Not that it matters now since the CO is willing to let him slide through anyway.
So enlighten me how that was not a lie ? You are contradicting yourself.

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
