Cuban Mother-in-Law Visit

Hello,

My husband is in the waiting process before we can apply to remove the conditions on his green card next year to change it from conditional to permanent. We want to bring his mom from Cuba to stay with us for as long as they allow her to visit. We don't necessarily want to apply for a green card for her, just a visit. My questions are:

• Does he have to wait until we remove the conditions on his green card and it becomes permanent before he can invite a family member?
• Can I invite her as my mother-in-law?
• What type of visa would we need to apply for?

No invitation necessary for a visitors (B) visa. Your MIL will need to apply on her own, showing intent to return to Cuba and the necessary financial funds to support her stay in the US.

Intent to return would be a round trip ticket? She just walks into the embassy and says she wants to go visit her son? It's Cuba, no one gets to leave unless they have a visa and even then not everyone gets to leave.

Does anyone out there have experience with Cuba?? The process that my husband had with his K-1 visa was different because of the relationship between the US and Cuba so I am wondering if other rules apply to bringing relatives?

Ah, of course, Cuba is a little special I guess. I thought that had improved recently though? Anyways, hopefully somebody with local knowledge can chime in.

In general:

She would have to file an application and schedule an interview before showing up at the embassy, check out the embassy webpage for the procedure.

Intent to return is not only a ticket back, but proof of ties (financial, family, property, work) to her home country. For certain countries (and I'm guessing Cuba might be one of them), they are very strict.

Cuba is very different. She doesn't work nor does she own her house. There is no reason for most Cubans to want to return so it is really hard to prove I guess. Internet is extremely limited and expensive and I don't think she has ever used a computer. It is something that I think we can do from here up until the point of her interview there. I will cross my fingers that someone in my shoes has gone through this and will respond son.

A round trip ticket means nothing.

People buy round trip tickets all the time without using the return part. Sometimes it's even cheaper than a one way ticket.

And the embassies specifically advise people NOT to buy tickets until they have the visa.

You and your husband can send an invitation letter, but it would not be considered in granting a visa.

Your MIL needs to apply for a B2 visitor visa. All applicants are legally presumed to have immigrant intent. An applicant would need to overcome this presumption to be granted a visa. Overcoming the presumption means showing strong ties to one's country to show that one has reasons to return home. Strong ties includes jobs, assets, family and social connections. A return plane ticket is of no value in overcoming this presumption because anyone can buy a return ticket and not use it.

I just wanted to reply back to my own question so that anyone following or interested in bringing a family member from Cuba for a visit only.  My mother-in-law's visa was denied and they told her that her reasons were not enough to warrant a visit.  We cannot apply for a year and quite frankly I agree in that I think that if we had been applying for a permanent visit we would have had a better chance. I know that if we get a second denial it is a 5 year wait as other family applied twice and that was the outcome.

Who told you that they couldn't reapply for a year and what was the reason?

There's no limit to how many times you can apply, they love being given money by hopeful people!

You can apply the day after a refusal if you like, you're 99.99999999% likely to get exactly the same answer but you can apply.

The paper she was given after her interview at the embassy in Havana that included the decision said that she cannot reapply for 1 year.

Never seen that before, all of my denial letters specifically said I could reapply at any time but without a change in circumstances I would probably be denied again.

@lasiren7174 can you scan the document, black out all personal information, and share it with us. Never heard of an applicant being told that they have to wait a year before applying.
