Hi,

My wife entered US for first time on immigrant visa (F2A application) last month and her port of entry was JFK Airport. Her Green card on passport expires in 4 months. We got married in Sep 2014 and we have 4 months let for our 2nd marriage anniversary.

I read couple of forum that says we need to apply for I-751 petition to remove the condition and to receive the physical plastic green card.

Can anyone please help if that's the process or I should just wait to receive the Green Card.

Please advise.

Thanks

hi

did she pay for the card before entering? she has a stamp in the passport, the i551 valid for 1 year until she gets the physical GC

the removal of conditions is not based on your 2 year anniversary, it's based on the expiration of her GC

once she gets the GC, 90 days before it expires in 2 years, she can remove conditions

Please check the I-551 stamp in your wife's passport. The stamp should be good for 1 year after entry.

ROC is on the 2nd anniversary of her green card and not on the 2nd anniversary of your marriage. Since you were married less than 2 years when she entered the US, she gets a 2 year conditional green card. She is required to file for ROC on the 2nd anniversary of getting her 2 year conditional green card and not on the 2nd anniversary of your marriage.

Since she only entered last month, it could take a few more months for her to get her plastic green card. Did you pay the green card production fee?

Thanks Aaron for your wonderful reply. I don't see anything stamped like I-551, only stamp i see is with F-21 hand written and registration number. Her IV on stamped green card expires on 02/Sep/2016, so I am bit concern. I hope that plastic card arrive before this expires.

I paid $165 before she flew from India, I guess that's the fees for Green Card ?

Thanks.

Thanks Aleful, She has expiration date of Sep/02/2016 stamped on her passport so I am concern. I don't see any I-551 stamp on the passport. Yes I paid the fees of $165 online before she came to US. I hope I receive Green Card before the expiration date. Is the category IV Category as F21 correct ?

It's not an I-551 stamp -- rather, the immigrant visa magically turns into an I-551. The immigrant visa has text on it that says something like "upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year". The "endorsement" is the visa having an entry stamp on it upon entry. The visa turned into an I-551, and this I-551 is valid for 1 year from the date of entry. It doesn't matter when the "visa" expiration date is; the "visa" is irrelevant now (it's a single-use visa anyway).
