Hey All,

We are a bit worried here as our I-130 package was signed for at the Chicago Lockbox on April 28th but we have not received NOA1 by email or SMS despite requesting it and nothing in the mail yet.

We cannot see if our check was cashed as was got a check issued from our bank (a bank check) and as such the funds were taken from our account when we got the check.

We're not sure exactly what to do :/

Anyone got any thoughts?

I'm still fairly new to this process (and anxiously waiting myself between delivery and NOA1), but 3 weeks to get NOA1 seems quite long compared to timelines I've read here. You can always call your bank to see if the check was processed...I presume you have a receipt or copy of it? Also would not hurt to follow up by calling USCIS.

I have wondered if May will be a bit slow since it's the onslaught of the premium H1-B processing.

We are currently just waiting for the Biomentrics appointment right now. It's on the 27th. :) My husband said that he read somewhere that if he is Canadian, sometimes the work papers get approved faster? I don't know how true this is... can anyone confirm or deny?

If you don't mind - what is a biomentrics appointment? I'm not sure I'm up to that stage yet? Are you applying for a Cr1 visa too? Thanks Panda! I would definitely get in touch with USCIS guys! It doesn't hurt to inquire :) I have heard many stories of people not being sent emails or messages! Definitely hit them up! Let us know how it goes :)

We just called them and they've said we definitely should have heard something by now, so my wife needs to speak to a higher level person and they've scheduled her for a call back :/

January 15th 2012: Met my future wife online.

June 4th 2016: NOA1 received by Email with May 31st acceptance date.

June 18th 2016: NOA1 hard copy received in mail - case sent to the Nebraska Service Center.

October 18th 2016: Case transferred to Texas Service Center

November 23rd 2016: Contacted State Senator (Marco Rubio) to ask for assistance.

December 19th 2016: Marco Rubios' office replied.

December 30th 2016: NOA2 Received by Email. Case Approved.

January 8th 2017: Case sent to Department of State (NVC)

January 19th 2017: Case Received by NVCNVC case number assigned. Invoice ID number received.

It's the appointment you go to where they get your fingerprints, get your photo, and sign some documents.

We got our call back and they're telling us our paperwork was rejected because it was "improperly filed". They gave us a receipt number and we looked it up online but it doesn't give any further detail.

We are not quite sure what could have been missing or improper from our packet as we followed all the instructions to the letter. It was mailed back to us on May 6th so we just need to wait for it to turn up I guess. The person on the phone said it should include detailed information about why it was rejected and how to re-submit it.

Hi Oliver ~

So my understanding is that for CR1 visa, we do the biomentrics (we - being the foreign spouse) at the visa interview. I know that before I go for my interview, I have my fingerprints done etc. I researched a little because I was a little confused too - apparently those people who are adjusting their status have a separate biomentrics interview which is I guess the same thing, but it's an interview. If you're doing the CR1 visa then you should have biomentrics done at the embassy. Well. This is what I've come up with! If anyone can correct me or add on, you're more than welcome to! :)

WHATTTTTT?! Improperly filed??? Oh my gosh. I wouldn't even know what to do there! I hope it reaches you fast so you could get some answers. So sorry to hear that Zach! :(

So it turned up in the mail this morning. They rejected it because our check was not valid apparently. This really upsets us as we checked with USCIS themselves on the phone before obtaining this check from our bank and they stated it would be fine. We also spoke with other Americans here in Cyprus all of whom have had checks of this type issued via Bank of Cyprus and cashed by US institutions without a problem. The bank itself said it should be fine as its done in partnership with their US affiliate Citibank.

*sigh*

We are going to DHL the entire package to my wifes uncle in California on Monday - it should get to him by Wednesday and he will put in a check for us from his bank and then overnight it to USCIS.

Just very very annoying as we have basically lost 4 weeks on this - it'll be May 27th or 28th before USCIS receive it again, and they previously received it on April 28th so yeah, a month.

Zach, that's terrible! I can't believe USCIS gave you this information and it didn't work out!! Thank goodness you've figured out another alternative! My husband went back to America on the 17th so we knew he would send it from there as we didn't know how to pay otherwise! I'm sorry you've lost a month :( Here's hoping for a speedy I-130 processing for you! Keep in contact! Hopefully this time it'll be accepted with no worries!
