I-134 AND I-184 And sponsorship and Household members

Timeline

If the required tax form is from last year or three years ago, then when does the I-134 (100%) of the poverty guidelines or the I-184 (125%) forms have to be signed if you that year has passed already? And what if you get laid off from that job and get a new job?

For example: 2015,2014,2013 TAX RETURNS and w2's, file for visa in 2016 but laid off from previous job but has new employment

Has sponsorship and household member willing to assist with support

I-134 is for K1 (fiancé visa) only, I understand that you are filing for a spousal visa?

The poverty guidelines is to help determine whether you fall below or above the poverty range. That will help CO or immigration know your beneficiary will not be a financial burden on you and then to the state (government).

Your previous tax return helps to determine income stability and also to determine if you pay taxes. because you can't get immigration benefits without taking care of your tax obligation to the nation.

So if you have new job, income an employment letter from your HR and a couple of paystubs.

So the tax return in not just to show that you have a job, but you have being paying taxes also.

Whether to use 100% or 125% depends on the category you fall under (usually military or civilian) and your state will determine how much that means. The poverty guidelines form is self-explanatory.

This is a little confusing to me could you clarify and relate this to my question? "And what if you get laid off from the job from that you had 2012-2015 and get a new job in 2016"?

Timeline
The visa you are filing for is relevant, since there are different forms to fill out depending on that. If you are married, you will be filing for a CR1/IR1 visa and will submit the I-184 with the necessary supporting documents (not with the initial package though).

So, your (tentative?) situation is this:

The USC was employed 2013-2015, and has W2's and tax returns from these years. In 2016 (?) he/she lost his/her job, but regained new employment?

Then:

The tax returns and W2's will show a history of earning above the 125 % poverty line, and letter of employment for his/her new job stating salary + paystubs will show that they will earn enough to support the immigrant in the future.

If it isn't difficult, it isn't worth it.

@ A'n'L Thank you for the clarification, but I dont understand this "(not with the initial package though)"

And I came up a little bit short from the guidelines of 125% but I am over the 100% and they said that if I am using the I-134 It needs to have been signed in 2015, I think I am being forced to change our path to the CR1 instead of the K3.

You will not submit the form and supporting information for financial support with the initial package you send to the lockbox. This will be requested later (NVC stage).

You can't choose between I-134 and I-184. The K-3 visa is very rarely granted (and requires a pending CR1 petition), so you are applying for a CR1 (use form I-130). For that visa, you must use the I-184 form for affidavit of support. That again means that if you can't meet the 125 % requirement, you will need a co-sponsor.

If it isn't difficult, it isn't worth it.
