i130 approved, but wants to move to the USA illegally

I have a question. I have a friend with a very interesting situation.

My friend, an adult over 21 year old, US citizen petitioned her sister via i130. After a few months the i130 was approved. However, now the beneficiary sister wants to move the usa illegally before waiting until a visa becomes available.

1. What happens with her i130 once she is in the USA?

2. What happens if she gets caught crossing? what happens to her i130?

Any reference to USCIS documents would be great!

Thanks!

hi

nothing will happen, but she won't be able to get the visa, so it will have been a waste of money

she has to wait over 20 years in her country

she can try to get a tourist visa and visit, but nothing else

she has to leave before her visiting time is up

Short answer to both questions... Nothing good.

Willing to bet the sister has already made the decision to come illegally. Which would be a waste of a visa to someone more deserving.

Please advice against.

That's a dumb idea. Do things the right way.

If the sister is a skilled worker, she can apply for a US Job, secure a work visa, and have legal status while waiting for the I-130. If shes still has US legal status when the I-130 is approved she can choose to file for consular processing or adjustment of status.

If you can't do it legal, don't bother. You are messing things up for those of us who wait our turn in line and do things the legal way.

There is no forgiveness with sibling petitions. IF she get a bar from being illegal then there is nothing a sister can do to remove it. People who come illegally are not going to have opportunities in the US that they seek. This thread is a TOS for asking assistance on doing something illegal.

This will not be over quickly. You will not enjoy this.
