Unobtainable police record certificates?

I am trying to get criminal record checks from both Thailand and Vietnam for my parents as requested by the NVC. The problem is for both Thailand and Vietnam, my parents left Vietnam as refugees during the war, and my mother went to Thailand as a refugee. Therefore, I wouldn't think they would have records for them in this case because the instructions from the State department requires a household registrant book for Vietnam and a household registration or identification card for Thailand. Both of my parent's do not have any such documents because they were not issued them as refugees. I still went forward with the instructions set out by the NVC website (https://travel.state.gov/content/visas/en/fees/reciprocity-by-country.html) but ran into roadblocks for each country.

I was also told by the police in Vietnam that they couldn't find a record without the household registration book, and that they would create a 'fake' police certificate for a bribe of $1500 USD. I have not received a response from Thailand in over two months now since mailing them the required documents minus the registration or identification card. Any suggestions on what I should do here? Tell the NVC I cannot get these criminal checks or try an alternative method to obtain them?

Hello Richard,

I am in the same case: my parents left Vietnam and went to Thailand as refugees 34 years ago. They were few years above 16 when they left Vietnam.

And I also need to get the Police Certificate from both these countries for the NVC.

I would be interested to know how your application went? Were you able to finally get the Police certificates, or did you provided an explanation to NVC?

We had an immigration lawyer deal with the specifics for filing the papers to the NVC. She sent the NVC an affidavit stating that the criminal record check from Vietnam was not obtainable and that they had asked for a bribe instead. Fortunately, the NVC allowed us to forego the criminal records from Vietnam and we no longer needed to apply for them.

However, for the Thailand police record checks, I had sent my immigration lawyer the receipts and transactions I received from attempting to obtain the Thailand record check as evidence, which she sent to the NVC. They still want us to attempt again to obtain the Thailand police record checks, so unfortunately I don't really know how to deal with this part. I am thinking about sending to Thailand again but with scanned printed copies of my parents' passports, etc. However, the good news is that the immigration lawyer says we are close to an interview for the immigration visas. Good luck on getting your certificates and immigration visa.
