Timeline

When filling out I-485 form, under Part 3B it asks if husband /wife is "applying with you" what does that mean? applying for what? another I-485 or what? If the spouse is a US citizen he or she would not apply for I-485, obviously

Also in part 3A wgere it asks for gender I suppose that's the non US citizen K1 visa holders gender that they ask. Is that correct?

3B says "List your present husband/wife, all of your sons and daughters (If you have none write "none." If additional space is needed us separate paper)." I don't see where it says what you stated. You list husband or wife, along with any children in that section.

3A is all about the non us citizen that is adjusting status.

For each person that you have to list in part 3B there are eight boxes :Family Name, given name, middle initial, date of birth, country of Birth, relationship, A# and "Applying with you?"
A# and Applying with you is for any children that may be immigrating with you. For your US citizen Spouse you put None for A#, and Check No for applying. Just like in the example form.

I have a follow-up question to that posed here....I have a son who didn't come with me to the USA (he is 19) and at this stage he has no intention of moving here either.

Which leads me back to the question involving 3b, do I put his name and details on the I-485 ?

It says to list all children, not just the ones who may someday immigrate. simply list him and mark the box NO

I have a related question. If the K2 child will follow later, how do you answer whether the child is applying with you?

UGH!! well I just sent in the entire package and completely forgot to tick off the "yes" or "no" - so now we have the k2 child to follow listed but we didn't put any x in either box.. will this cause an RFE ??? and if we do get an RFE how much delay will this cause and will it affect the I-131 timeline ? thanks!!

well I just realized I may have checked yes even thought the answer might be no.. how important is this stupid question ? oh well I guess worst case is RFE but since we are already here in America it's not the end of the world.. right ?
