My husbands visa was unfortunately denied yesterday due to his overstay.

If anyone out there who has suggestions for a lawyer with REASONABLE prices

and a sense of actual care for the situation they are dealing with, I would greatly appreciate it.

There is no way we can qualify for a expedite from the USCIS, but with a baby on the way, I need someone who will do anything they can to get the paperwork moving for us.

How long was his overstay? What are your hardships?

The easier your case obviously the cheaper it will be

A simple overstay needs an i601 waiver. You can do it yourself but if you're in a hurry, it's better to get a lawyer. Pregnancy is not a reason for expedite However....you never know. Ours was expedited because I lost my job and my unemployment benefits were running out. File the waiver and then when it's been accepted, have your husband or lawyer call for an expedite. Uscis will not talk to you the petitioner since it's not your waiver. I used to get my husband on a 3way call with uscis so we could try to get status.

The denial is expected at the interview. You have to get the denial before you can file the waiver. They will tell you right then if you are eligible for the waiver and they give you the instructions. Did they give you the waiver instructions?

Yeah, I'm aware of all of this and know what paperwork needs to be filled out. I want legal assistance because I don't want to make any possible mistakes myself, and want someone who is experienced and can work quickly on filling out the paperwork and getting the waiver sent in. I know that a pregnancy isn't something the USCIS cares about, I actually don't believe they care at all, but I was just looking for lawyer suggestions.

Immigrate2us.com has a whole thing on waivers and lawyer contacts. There is a Facebook group that can give tons of suggestions. I used a local lawyer in Philadelphia.

My guess is that it would be best to work with someone locally. I am not sure where you are based, but here's one short list to browse: http://www.bulgaria-embassy.org/webpage/Consular%20Information/BG_Lawyers.htm. Not sure how current all the listings are unfortunately, but I know for a fact at least one of the people on the list who does practice in NY and IL, as stated.

Google Lizz Cannon. She's highly recommended and decent priced. She recently moved to FL but you'll have no problems working out of state with her.

I used Allan Lolly who is based in San Diego. He has a lot of experience dealing with overstays and cancelled visas. He also offers a payment plan if you cannot afford the cost up front. He gave me a lot of accurate information upfront and is very thorough. Everything went as he told me it would. Our 212 and 601 waivers were approved this past December.

November 2013 - Met online: Match.com
December 6 - 8, 2013 - Met in person for the first time in Mexico.
February 2014 - Filed for K1/K2 Visa
April 2014 - K1 Visa Approved
March 19, 2015 - Attended interview in Juarez. fiancée denied. Allowed to file for I-212 and 601 waivers
June 25, 2015 - 212 and 601 Waivers received at Phoenix lockbox and forwarded to Nebraska Service Center.
December 21, 2015 - Waivers Approved
December 28, 2015 - Instruction letter received. Request for passports and new medical.
February 1-3, 2016 - Trip to Juarez for new medical and submit passports to consulate.
February 5, 2016 - Medical documents and passports received at consulate.

February 12, 2016 - Passports with K1 Visa picked up from DHL in Tijuana.
February 22, 2016 - Entry into California through Otay Mesa POE without daughter who decided to stay in MX.
April 30, 2016 - Married!!!!

AOS, EAD, AP Process

June 1, 2016 - Mailed adjustment of status packet.
June 15, 2016 - NOA1 Received I-485, I-131, I-765
July 8, 2016 - Biometrics Appointment
July 25, 2016 I-485, I-131, I-765 Cases appeared on USCIS Website.

August 29, 2016 - EAD/AP Card received via USPS Priority Mail.

November 21, 2016 - Received text that Interview has been Scheduled for 12/21/16

December 21, 2016 - Interview in San Francisco

December 29, 2016 - AOS Approved, 

I-751 ROC -Process

December 6, 2018 - I-751 Received Phoenix, AZ Lockbox

January 28, 2018 - File receipt and extension letter received.

August, 2020 file transferred to be adjudicated with N-400

July 6,2021 Combo Interview Scheduled in San Francisco

August 3, 2021 ROC/ Naturalization Interview

August 6, 2021 ROC Approved

N-400 Naturalization Process

June 14, 2020 - N-400 filed
