GUYS HELP , HELP < HELP > HELP please!!

ANY BODY KNOWS ARE THE STEPS HOW TO :

1, File a Divorce.

= what are the papers need to send to the court or to file.

2, change of address,

= correct forms to collect and to sends,

3, file for ROC,

= forms for this case.

4. or suggest what are the steps guys. I'm very depressed and i need your help.

i need more little of help to all of you guys,

I am separated with my partner , i am now living with a new address and new home.

our relation didn't went well, and we going to file a divorce , as for now i walk out the house and live somewhere as i we talk and we don't want talk about our problems at all. so we decided to separate and file for a divorce, but we try many times to fix our problems and issue in between two of us, but it didn't went well,. as a K1 base visa , and now a PR holder ( Green card) for two years, is there any possible for me to remain in the state until the expiration date .

for filing a divorce , we don't have a lot of papers and even a pictures as he really hate someone took a picture of him, WE JUST ONLY HAVE JOINT BANK ACCOUNT, we just renting the house that we live together but he live there for many years, . is that already okay or enough evidence for my ( ROC )? when my divorce file is final , when should i file for ROC? ( my GC expired 2017 / 12 ) next year.

guys if you have idea how to file this case, i really do need your help,

you are from the PI ? suggest the USCitizen file the divorce petition, the USCitizen be the petitioner in the divorce case.

Coupla things:

Divorce:
1. the county website has instructions on how to file, giving sometimes example documents. Find it, study there today.
2. if you two not want to engage a lawyer, you'll need to prep the documents yourselves.
3. There are 3 phases of a divorce:
__a. File a petition with the clerks office - no hearing required.
__b. File any temporary orders, attend any hearings about the temporary orders.
__c. Prove up by Petitioner during a divorce hearing.
then the divorce is granted.

Immigration Stuff:
To successfully file a RoC casefile, you'll need to gather up evidence of a bonafide marriage, evidence that you two co-mingled the finances and money. Then tick the 'divorced' box on the form. We have a Guide in the Guide section, so use a PC with a real web browser and study the guide, downloading the USCIS forms as well. If you're stuck on a handphone right now, get into a library and use a PC there. Bring a usb memory stick to save the forms and instructions, print it out later.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Timeline

If your 2-year GC expires next December, that means you just got it in the last couple of months. Divorcing immediately might look a bit suspicious to USCIS (I'm just saying how it looks, not that it is the case.)

Divorce is handle under state laws. Your county's web site probably has templates to self file for divorce. They also typically have legal aid to assist you in self filing. You'll need to contact your county's family court to get details.

As a Philippine citizen, you can never get the divorce recognized in your home country if file for the divorce. But if you never registered your marriage with the embassy, this won't matter, as they will have no record of it. If you did register your marriage, let your husband file for the divorce.

From what you said you have for evidence, you are going to have a very difficult time removing conditions.

I'm very depressed , we married last year June and i got my green Card december , and i have a problem in our relation now were separated , how can i handle this?

I'm still able to file for my ROC ? , its my affidavit of support will end if the divorce will finalize this year?

Affidavit of Support stays valid regardless of divorce. It is only needed for that original green card.

You can file to remove conditions on your own. There's a box to check off if you're divorcing or divorced. You will still need to prove a valid marriage, which given the short time period might be difficult. Save any documents of living together, doing things together and mingling of finances.
