Filed taxes as single- problem? (split and merge)

Hi all I m New to this forum I have 2 question on my w2 and taxes transcript my status is single,but u petitioned my wife who life in Congo in Africa and never been to usa,so she doesn't have a social security, and I can't not filled as married filling separately, Will it be a big problem for the interview, my second question is to know if all f2a need Cenomar?

First question. Nope, theres no problem filing as single. My husband filed as single too since im in the Philippines and I do not have SSN. Second question, cenomar is for the Philippines, Im not sure about Africa.

First question. Nope, theres no problem filing as single. My husband filed as single too since im in the Philippines and I do not have SSN. Second question, cenomar is for the Philippines, Im not sure about Africa.

Wrong. This is tax fraud. You must file as married filing separately. An itin may be obtained in place of a ssn

Wrong. Husband = married, not single. Your husband should have filed as married filing separately.

First,thank you for your feedback,but why the nvc didn't say anything,because I sent them my w2 and tax transcript with status as single,I know I should have status married,but like I said my wife is overseas never been to usa,so don't have a social security number,if the nvc didn't made a big deal do you think the consulate embassy will

They're not the IRS. If you're ever audited you're screwed

To your advanfage to file married / pay less taxes as you get to claim her

File the W 9 with your return and copy of her birth certificate and your marriage licence in both lanaguages

W 9 gives her a ITIN (indivudual taxpayer ID number)

You can only file the W 9 at tax time

With this W 9 you can also add her to bank account although no bank will give her a debit card until she is in the US

but adding to your bank account shows additional evidence in relationship as does putting her on your taxes

The issue isn't with the NVC. The issue can be at the interview when the interviewer is like "why is your spouse filing taxes as single? Are they hiding your relationship?" That is the issue during immigration. It's rare and more likely a question to be asked in high fraud areas but the chance is there none-the-less.

By the way, my packages are now in NVC sonce Friday. Do I have to call them right now about my case or wait about a month? Thanks

hello everyone i going thr the same thing and now i am so fustrated ,, :( we filled w2 and irs as a single and the interview at the consult after few days and we can't do nothing about it ,, we called the irs already many time tried to explain that we are married but but they keep asking are ur spouse in US ? no . are he or she ever been in US ??? no are ur spouse ever work in US or file or any kind of income tax ?? no ,, and was the answer was so u have to sign it as a "single" and even there at the office where we fill the 2015 W2 the lady asked the same questions and the answer was NO in everytime so she sign it as "single" herself and she said that they could change this only when ur spouse be there and have a SSN ,, now i dont know if the CO will mention this in the interview and what i should say ? and if i can explain that to him ??? or if i will face any kind of AP for this thing plz help me cuz i see here some saying "YES" and other say "NO" and i wander if anyone face any kind of problem cuz this issue ??
