ROC concern - please help!

Hello,

I'll be applying for my ROC soon and we're currently in the process of gathering as much evidence as we can. But I'm concerned about one thing. I've read tens of entries on couples sharing their experiences with ROC and I've noticed that most of them included proof of shared ownership of properties such a real estate or a car. I've also seen copies of joint leases. In our case, my husband owns the house and the car - which makes sense since I joined him in the US years after he purchased those properties.

It's obvious that shared ownership of properties is a sold evidence, but what if we're missing that? Has anyone of you got approved without it?

Try to add your name to utility bills,car and health insurance and any bills which shows your both names in same address.

We have been worried about this, too, but I've tried to do everything I can to have my husband show joint RESIDENCE even though I own the house. (In my case, the house has been in a domestic trust in my name only since long before we married -- since it was set up as a domestic trust, my husband legally cannot be added until he becomes a naturalized citizen!)

Here's what we're including: a copy of the deed to the house in my name; property tax statements for the last three years in which we SPLIT the payments equally (he paid half each year, I paid the other half -- we have the receipts to prove each payment); a notarized affidavit from each of us stating we reside together; an affidavit from my parents stating we reside together here; and many many utility bills which are either in joint names on the account, or at least addressed to both of us even though I'm the account holder. Plus of course other official and unofficial bills/letters/statements sent to him only at our shared address, to show he really does live here.

Last but not least: a half-page explanation of our deed/trust situation, so the officer can understand why my husband is not on the deed. I think the explanation is the most important: as long as you explain your situation, they cannot ask for things that do not exist, and you should have plenty of proof that you actually do live at that residence. You do not have to share every piece of property: you simply have to show that you are living a co-mingled life together and sharing at least some of the responsibilities of daily life.

POE San Diego, September 13, 2013, Wedding October 25, 2013

AOS filed November 19, 2013, EAD/AP received January 30, 2014, interview and AOS Approval on February 27, 2014.

ROC filed December 3, 2015, NOA1 12/4/15, Biometrics 12/31/15, ROC Approval on June 16, 2016, 10-Year Green Card received June 22, 2016.

N400 filed September 14, 2023, same day acceptance and Biometric Reuse notice, Interview on 2/13/24: Passed and same day oath. ALL DONE WITH USCIS.

No RFE at any stage, thanks to VisaJourney!

2015 December 03: mailed I-751 package

2015 December 04: NOA1 extension letter, 2015 December 31: Biometrics appointment

2016 June 16: Approval - Online status changed to Document Production, mailed 6/20/16

2016 June 22: 10-Year Green Card Received, done with USCIS for a while!

 

N-400 Citizenship:

2023 September 14: filed N-400 online

2023 September 14: same day acceptance notice and "Biometrics Reuse" notice

2023 December 28: notice of interview scheduled for February 13, 2024

2024 February 13: naturalization interview (five-year rule) passed, same day oath - now a US Citizen and done with USCIS!

Yes people get approved without joint ownership.

Financial co-mingling can include or exclude ownership of items.

What items do you have thus far?

Life insurance policies (noted above) with each other as beneficiary; any retirement/401K with spouse as beneficiary; joint bank/credit card accounts; and perhaps more importantly (for life more than ROC as TboneTX always says), wills and medical power of attorney forms. Good luck!

you can actually be added to the deed by a quick claim deed / examples online / readon not necessary in some states is the state may be a community property state / if so, you are automatically half owner of assests.

I was able to add Adil as joint owner on deed while he was still in Morocco

for us immigration wanted to see co minglinging before he even came

get added to banking account and get a bebit card

Your objective is to demonstrate that you have a valid marriage. Co-mingling of assets can certainly be part of that, but it is not required. It is important to demonstrate that there is co-mingling of finances, habitation and family life. Joint accounts for utilities, insurance, credit cards and bank accounts support that you have a genuine marriage. Affidavits from friends, family and others who have known you as a married couple since you were married are important. Documentation of family vacations and activities during the past two years are important.

If a reasonable person would view your documentation as evidence of a bona-fide marriage for the past two years, then you will likely be OK.

Technically, if the property was owned before marriage, it's separate property in community property states. Anything purchased AFTER marriage is community property in community property states.

Many people mistakenly believe the word is quick claim.

But there is no such thing.

QUITCLAIM DEED.

However, this would be a dangerous tool to use.

Quitclaim deed says that whatever ownership rights you have . . . you 'Quit' your claim to this ownership in favor of the person you designate.

But you don't want to give up your ownership rights . . . you only want to share ownership rights.

July 24, 2017  ROC packet signed for in Vermont.

August 8, 2017  NOA received at house.  15 days since ROC signed for in VSC.

August 12, 2017 ASC appointment received. 19 days since ROC in VSC.

August 25, 2017 BIO completed. 32 days since ROC received in VSC.

August 11, 2018  18 month 'Courtesy Copy' extension letter received.  Critical number  297

October 20, 2018 18 month 'Official' extension letter received.  Critical number 297

December 4, 2018  USCIS Account shows: We approved your Form I-751, Petition to Remove Conditions on Residence, 

December 4, 2018, ordered your new card for Receipt # EAC17297003XX, and will mail to the address you gave.

491 days from NOA issued by VSC until Petition approved.

December 7, 2018 USCIS sent notice:  Card mailed.

December 12, 2018 Ten year Green Card received from Lees Summit, MO

499 days from NOA issued by VSC until Green Card received.

CITIZENSHIP PROCESS

December 6, 2018 submitted N-400 application on-line.  Estimated Completion Time: 8 months or August 2019.

December 8, 2018 received notice on USCIS that Biometrics scheduled . . . but the actual date was not yet shown.

December 11, 2018 saw in 'Documents' section of USCIS that Bio scheduled for 24 December 2018.

December 21, 2018 saw on USCIS website that they will be closed 24 December 2018 as extra holiday.

January 9, 2019 went for re-scheduled BIO appointment.  33 days after N-400 submitted on-line.

February 19, 2019 received letter in US mail that Citizenship interview scheduled for 26 March 2019. 74 days after submission on-line.

March 26, 2019 Citizenship interview scheduled for.  109 days after N-400 submitted on-line.

March 26, 2019 Passed Citizenship interview.

April 12, 2019  Received notice that Oath Ceremony had been scheduled for 24 April 2019.  17 days after interview.

April 24, 2019  Oath Ceremony completed.  29 days after interview.     139 days after N-400 submitted on-line.

April 25, 2019  USA Passport Application submitted.

May 3, 2019     USA Passport received.    149 days after N-400 submitted on-line.

May 9, 2019     Certificate of Naturalization and Citizenship returned in mail.
