My wife is filling form I-485 for her mother, now we are doing form i -864, my question is:

can I file this form using my name and income information and totally ignore my wife or should i put my wife as

the sponsor and I'm a joint and file i - 864 A

If she have to be the sponsor :

in part 1 do I put her name and select 1.a

or

1.e " I am the first of two joint sponsor"

if she doesn't have to be in the form :

do I put my name and select 1.a

If I am not mistaken your wife should fill out Form I864 even if she doesn't have an income and you as the joint sponsor should fill out Form I864A. In part 1 of Form I864 let your wife check the 1.a that states she is the petitioner. For your part in Form I864A, you have to check part 2 1.c that state you are not the intending immigrant but you are the spouse of the petitioner. You cannot be the petitioner for your mother in law because you are not her immediate relative only your wife. Hope I was able to help.

hi

the petitioner is ALWAYS the primary sponsor, so your wife fills out the i864 as sponsor and you fill out the i864A as her household member

she is the sponsor, so she will check I am the sponsor
