Timeline

You can file for ROC alone with divorce waiver if you have enough evidence of good faith marriage, like joint bank account,joint utilities,lease,insurance,etc.. The divorce should be finalized before filing this or the USCIS will send you RFE.

We dont have any joint account. She never wanted to add me on hers and because she didnt want to add me I didnt add her on mine. I have bills on my name, that comes where we live. We did not buy anything together, we dont have any property together. Shes selfish and she wants everything just for her.

what is this ROC I see a lot of members speaking about? I would like to know I am an US citizen that is filing for my husband to come aboard but, have seen many marriages falling about and that is a BIG thing I see here on the site.

ROC means Removal of Condition, in your case, that will be the process to change the 2 years conditional green card into the 10 years GC. Don't be afraid of the falling marriages, not all people,situations and marriages are the same.

Well your situation is hard, you need a lot of good faith marriage evidence as I mentioned in the previous comment. You can try to show your driving license and your bills with her that they are coming to the same address. But you don't have strong proof of financial co-mingling.

Do you have ANYTHING joint? Health insurance?

Your wife chose to go through the visa process, which is expensive, long, and stressful. Not to be rude, but it feels a bit odd, that after you came here she became so selfish, she refused to commingle with you in any way.

Do you have photographs? Receipts of gifts you bought for each other? The fact that your license shows the same address as hers only shows you live together, it is barely an evidence of a true marriage.

I know of a couple of cases where the USC "freaked out" after the foreign fiancé came to America, because it is so different than spending two weeks vacationing somewhere, but even those couple of cases I've heard of got joint health insurance, a joint bank account, etc...
