Removing conditions application denied! Need urgent help!

My husband and I applied for removing conditions on his residency in July. We filed with all the necessary evidences.

He was called for interview. He went in with all the documents. He presented whatever they asked. It seemed obvious to my husband that they were overly scrutinizing everything but couldn't find a weak point.

We received a letter now stating that they have denied the application because I (the spouse) didn't appear at the interview.

No where on the interview letter did it say that I needed to go. I was home watching my two babies. The interviewer at the time said they would call us for interview again but they just denied the application.

Please help me out! I need to know what can we do now? Can we appeal? Reapply? How can we prevent removal proceedings? We are really worried please let me know if you know the next steps for us.

Has it actually been denied or did you get a notice of intent to deny. If it has truly been denied he'll likely be put into removal proceedings and will get a notice to appear in court. If it was me I'd be getting a lawyer asap.

Contacted my attorney when we had USCIS related problems, ROC was no exception, one of the top immigration law offices in the USA. He said he couldn't do anything, was honest, and for me to contact our senators office. Fortunately, our senator at the time was head of the USCIS committee, he got things straightened out in a big hurry.

You have two senators, the other one we had didn't even have an immigration department, so we contacted the other one, this was later in our stages. You must be lucky, very few are called in for a ROC interview, think someone there must be looking for more work to do.

You are more than welcome. Some don't even know who their senator is, just type in, "who's your senator" in google search, ask you what your zip code is and a window will pop up showing them. Some have a home page where you can learn if they have immigration help. Congressmen are not very helpful in this respect.

I also received permission from my wife and stepdaughter to act in their behalf, after all, they are my family! My two girls, relatively new here, were very frightened.

One thing about the USCIS, very curious if you committed fraud, and you are automatically considered guilty until you prove yourself innocent.

I contacted our senator earlier today. Our case is very straight forward. Nothing out of ordinary. It's very strange to me that even though they told my husband, they would call us again, they just denied the petition altogether.

For joint filing, your denial letter states why you were denied. When he received his appt letter it states that spouse is to be there. You will have to obtain a lawyer. They can advise you of refiling.

Thank you for your reply. I know they denied because they objected on my absence at the interview. However, I have read the interview letter several times. No where does it say that we both need to attend the interview. It's obviously clear to me now that I was supposed to go. But it's no use to discuss that now.

I think the senator's office would be able to help us out the best.

I would not put all your eggs in one basket. I would at least have a consult with a lawyer as a back up plan.
